Four employees of the Chinese University were accused of concealing conflicts of interest during the process of bidding for the project. Earlier, they were accused of misconduct and conspiracy to defraud by public officials and were tried.
One of the project coordinators pleaded guilty earlier and served as a tainted witness to accuse the remaining three defendants. Only three of them were eventually convicted.
The staff of Shanheng later applied to change not to plead guilty. Judge Shen Xiaomin approved his application today (29th). 4 defendants: Li Peishan (43 years old, director of Wu Yisun College of CUHK), Peng Zhaoheng (38 years old, brother-in-law of Li Peishan and proprietor of New Life Creative Design), Shi Xiaofeng (40 years old, administrative director of Wu Yisun College of CUHK), Liang Youcheng ( 36 years old, coordinator of the second level program of Shanheng College).
Liang pleaded guilty earlier, but later applied to withdraw his guilty plea decision and changed it to not guilty. He was approved by the court today.
The court held that CUHK knew and acquiesced to the tender arrangement
Shen Guan pointed out that the facts of the case mainly refer to the conspiracy of Liang and the first defendant in the case to defraud. However, after the trial, the court believed that the CUHK Business Team had known that it had acquiesced to the bidding by "cutting first and then playing later". The procurement process was only a fictitious one, so it ruled three. People are free from sin.
Therefore, Guan Shen accepted the defense's submission, stating that Liang's conviction was also unstable, so he approved the withdrawal of Liang's guilty plea application.
The prosecution intends to appeal the conviction of 3 people
Shen Guan adjourned the case for 9 months before the trial, so that the prosecution can handle the appeal and trial of the remaining three persons in the case first, during which the defendant can be released on bail pending trial.
