"Dangerous precedent": property developer would have to finance daycare - but the municipality does it itself

- Again the Free Voters (FW) failed in their attempt to remind the community of the socially acceptable use of land (Sobon) at Kreuzacker. According to the regulations passed in 2016, the property developers would have to build a day-care center in the new residential area in Schleißheim West and provide space. But the community is building the daycare center on its own property. The developers are to be asked to pay later. FW spokesman Stefan Vohburger cannot understand that the community takes the risk of making advance payments despite Sobon.

While the other parliamentary groups recognize a practicable solution in the decision of March to subsequently demand costs from the property developer, Vohburger suspects trouble.

Sobon not only obliges property developers to provide social infrastructure and to cover the need for childcare with their own funds.

Investors must also provide a plot of land for the children's home.


It takes that many daycare groups

A study published in autumn 2019 calculated a need for five primary school classes, ten daycare groups and 90 after-school care places for the quarter at Kreuzacker. Plans to build a children's house together with the residential area planned by the Catholic Men's Welfare Association in Mittenheim are off the table. The town hall does not want an oversized daycare center. The way for boys and girls to Mittenheim would be too far and too dangerous. Since then, a children's house has been available in the area around the Kreuzacker. The SPD has suggested repurposing the lunch service maintained by the neighborhood help at the indoor swimming pool.

“In fact, the community is building on its own land in the hope of getting the money from the developer at some point, and the local council praises the decision as a wise decision,” complains Negele.

The FW's reference that at the time of the decision in March the municipality was not aware that it had lost almost all reserves with five million euros, did not let the other parliamentary groups shake the decision.


Review: Nobody should feel obliged to the Sobon anymore

According to the FW, investors would only want to skim off the cream.

"If they can get away with it, a dangerous precedent has been set," warned Negele: Nobody would have to feel obliged to the Sobon anymore.


How it came about that Sobon apparently played no role in the negotiations with the developers, Negele cannot understand.

Two variants emerge: Someone may have forgotten to even bring up the Sobon provisions.

The developers may also put pressure on the town hall.

There was talk of impending losses in connection with the Sobon at an early stage.
