Indicted and remanded in custody since June 23 for "intentional homicide on a spouse", Cédric Jubillar, who faces life imprisonment, continues to claim his innocence. These lawyers will plead for his release at a hearing scheduled for Tuesday, July 6.

"She annoys me, I'm going to kill her and no one will find her

.

"

Such is the disturbing threat uttered by Cédric Jubillar during a telephone conversation in front of his mother, a few weeks before the disappearance of his wife Delphine, on December 15, 2020, we learned on Monday from a source close to the file, confirming information from the

But the defense believes for its part that these words would have been uttered out of anger, in the context of the tensions that existed in the couple or in that of a potential divorce to come.

During his custody in the premises of the gendarmerie of Gaillac (Tarn) from June 16 to 18, the 33-year-old craftsman remained on his line of defense. Faced with the gendarmes, he firmly and confidently contested his involvement in the disappearance of his wife. According to

Le Parisien

, a confrontation was organized between Cédric and his mother Nadine - herself placed in police custody - on the night of Thursday to Friday, June 18 in the presence of their respective lawyers. On the words spoken by her son during a telephone conversation she attended, Nadine, 50, explained that

"at the time, I did not take it seriously"

. Between two bursts of tears, she then urged Cédric to tell the truth.

"You are my son, I love you and I will always be there for you ... But please speak

.

"

And him to repeat over and over:

"I did nothing mom",

according to the story of the

Disturbing elements contested by the defense

At the end of June, a certain number of disturbing elements aroused the suspicion of the investigators and led to the indictment of the artisan plaster painter. During a press conference on June 18, Dominique Alzéari, the public prosecutor of Toulouse, pointed out a list of inconsistencies in the version of the facts as reported by Cédric Jubillar. It was notably a question of Delphine's car, a Peugeot 207, parked on the sidewalk in front of their pavilion in Cagnac-les-Mines (Tarn). The young woman used to park in the direction of the climb and the neighbors believe they remember that it was still the evening of her disappearance, according to the regional daily. However, this same car, the next morning, was found parked in the opposite direction, that of the descent. An argument that proves absolutely nothing according to the defense of the respondent.

Another disturbing element raised by the prosecutor, the presence of a duvet in the washing machine at the time of the arrival of the gendarmes.

And not just any duvet, the one Delphine Jubillar was supposed to sleep on that night.

For Cédric's defense, this element is not confirmed by any finding immediately established.

What is more, it is impossible to know precisely whether this machine was in working order and if so, since when exactly.

Delphine's husband never seems to have tried to hide this duvet from the eyes of the gendarmes.

This makes it improbable, according to the defense, the scenario developed by the prosecution which would have Cédric Jubillar cleaned up all incriminating traces inside and outside the house, called the gendarmes and then remembered that he had to wash this duvet.

Faced with investigators, he maintained that he had wanted to wash the duvet because at least one of his two dogs had urinated on it,

At a hearing scheduled for Tuesday, the Toulouse Court of Appeal will examine the appeal for the provisional detention of Cédric Jubillar. Its lawyers are contesting various elements deemed to be a charge against their client. Finally, without a body and without overwhelming evidence, it is difficult for investigators to establish the guilt or not of Cédric Jubillar. Questioned at the end of June by

Le Figaro,

Me Jean-Baptiste Alary, one of the lawyers of the defendant, had seen in this absence of serious and concordant clues, the proof that the indictment of his client was "

legally incoherent"
