The Hong Kong government plans to amend the "Personal Data (Privacy) Ordinance" to criminalize the "beginning" behavior, grant the Privacy Commissioner the power of investigation and prosecution, and have the right to request online platforms to correct content involving the "beginning".

Foreign media reported that the Asian Internet Alliance, formed by technology giants such as Facebook, Google, and Twitter, had privately warned the government that it might withdraw from the Hong Kong market and no longer provide services in Hong Kong if it promotes the relevant amendments.

The Office of the Privacy Commissioner for Personal Data stated that it has received comments from the Alliance on the amendment of the Privacy Ordinance, but emphasized that the amendment only involves illegal "beginning" behavior and refutes the argument that the amendment will affect foreign investment in Hong Kong.

It is understood that the Office of Personal Data Privacy strives to hold a video conference with representatives of relevant companies within this week to mediate the incident.

Chief Executive Lam Cheng Yuet-ngor responded this morning that if online platforms have concerns about the amendment, the Privacy Commissioner is happy to meet with them to understand their concerns.

Lam Cheng pointed out that in the past period of time, many people have been traumatized because of being "started" by others, and the society has widely supported the government to deal with the problem.

The Office of the Privacy Commissioner for Personal Data stated that it has received a letter from the Asian Internet Alliance expressing their views on the proposed amendment to the Privacy Ordinance to combat the "understanding".

The Privacy Commissioner for Personal Data Chung Lai Ling strongly refutes any claims that the amendments will affect foreign investment in Hong Kong. The Commissioner's Office reiterated that the amendments only involve illegal "beginning" behaviors and the relevant law enforcement powers of the Privacy Commissioner.



The amended law will clearly specify the scope of the "beginning" crime, and the amended law will not have any impact on freedom of speech.

The Privacy Office welcomes stakeholders’ comments on the amendments and will meet with representatives of the Alliance in the short term to get a clearer understanding of their opinions.
