The defense pleaded that the money in the account involved in the case had nothing to do with the proceeds of the crime. The defendant withdrew the money from the account mainly to pay attorney's fees and to repay family members who assisted in paying the attorney's fees.

The lawyer also pointed out that if he was told that he could apply to the High Court to obtain the funds from the frozen account, the case would not happen. He thought it was just using his future money.

However, the defendant received pension and elderly allowance in a restricted account.

After the defendant was convicted and sentenced in the peripheral gambling case in 2019, the prosecution applied to the court for confiscation of the proceeds of the crime. When the police prepared information, they found that the defendant’s pension had only a balance of more than 400 Hong Kong dollars.

After investigation, it was found that the defendant opened an account in Chong Hing Bank after the court issued a restraining order, and since August 2018, he switched to the account to receive pensions and pensions for the elderly.

From July 2018 to July 2020, a total of more than 440,000 Hong Kong dollars were withdrawn from the account involved.
