The Independent Commission Against Corruption today (12th) sued Au Chung-yin, a failed candidate for the 2019 District Council election, accusing her of fraud, providing entertainment to others to induce others to vote for her, and bribery in elections.

According to the case, the two charges involved providing singing performances and free calligraphy classes in October of the previous year.

The defendant has been granted bail by the ICAC and will defend his case in the Eastern Magistracy on Thursday (15th).

The ICAC stated that it had received a complaint earlier that someone was suspected of violating the "Elections (Corrupt and Illegal Conduct) Ordinance" and initiated an investigation. After consulting the Department of Justice, he prosecuted the 44-year-old Ou Songxian, an engineer.

The defendant was charged with two counts, namely, a fraudulent act of providing entertainment to others in an election, violating section 12(1)(a) of the Election (Corrupt and Illegal Conduct) Ordinance; and a bribery in an election The fraudulent conduct of voters violates section 11(1)(a) of the Election (Corrupt and Illegal Conduct) Ordinance.

According to the case, the 2019 District Council election was held on November 24 of that year. The nomination period was from October 4 to 17 of the same year. On the first day of the nomination period, the defendant submitted a nomination form to run for the Western District University constituency.

One of the charges alleges that the defendant was suspected of committing fraud on October 10 of the previous year, that is, providing entertainment to another person in order to induce the other person to vote for her in the election. The entertainment was singing.

As for the other charge, the defendant allegedly committed fraud on October 16 of the previous year and provided benefits to the other party without reasonable excuse as an incentive for the other party to vote for her in the election. The relevant benefit was the calligraphy class.

The ICAC investigation found that two street performers, at the invitation of the defendant, performed a one-hour singing performance near the exit of a MTR station in the constituency on October 10 the previous year.

The defendant held a free one-hour calligraphy class at the same place six days later, on October 16th of the previous year.

The defendant has been granted bail by the ICAC and will defend his case in the Eastern Magistracy on Thursday (15th).

The defendant then paid 1200 yuan and 800 yuan to the relevant street performer and calligrapher as remuneration, and declared the relevant expenses as election expenses in the election return.

An ICAC spokesperson reminded candidates, election agents and election helpers that it is a serious crime to provide refreshments and entertainment to others and bribe voters to vote during the election.

The spokesman also said that candidates should master the provisions of the "Elections (Corrupt and Illegal Conduct) Ordinance" and should not provide benefits, food, drinks or entertainment in exchange for votes in the election.
