65 days have passed since the Tigre tragedy, when Joaquín Duhalde Bisi (19),

drunk and without registration

, his father's Audi A4 hit a guardrail and

killed two friends

.

Since then, he has been in prison.

His defense asked that his

detention

be

restrained

: they argue that he has celiac

disease

and suffers from

asthma

, according to

Clarín

.

The boy's parents, the doctor Martín Duhalde and Soledad Bisi, "offered to have him fulfill the domiciliary in the house they share in the private neighborhood El Atardecer, in Tigre, under their care and responsibility," detailed the sources with access to the file. .

Prosecutor Sebastián Fitipaldi, from the UFI of Rincón de Milberg, and

the mother of Franco Rossi (18)

, one of the victims, represented by Natalio Nicodermo, a lawyer for Madres del Dolor,

oppose the domiciliary

.

"The (Joaquín) Alimonda family, the other victim, appeared with his lawyer to say that they

agreed with him being sent home,

" the sources described.

Joaquín Alimonda, Joaquín Duhalde Bissi and Franco Rossi were friends from school.

The fate of Duhalde Bisi, who at dawn on May 9 was fatally driving with 1.39 grams of alcohol per liter of blood and who had the record withheld for an infraction, will be decided by the Judge of Guarantees No. 5 of San Isidro,

Diego Martínez

.

Precisely, Judge Domínguez at the end of May

denied him release

from

prison

for the crimes of “double

simple

homicide

with eventual fraud” and, alternatively, “double wrongful death

aggravated

by the plurality of victims, alcohol consumption and high speed at the one who was driving ”.

Now, that same judge validated the preventive detention of Duhalde Bisi, housed in the Villa La Ñata police station, but

ruled out the most serious crime,

which had penalties of 8 to 25 years in prison.

"He was detained but for

aggravated manslaughter

, but with penalties of 3 to 6 years in prison," the sources added.

Spokespersons for the case explained that it is not the same to ask for the moderation of detention conditions when the sentence is expected is 25 years than when it is 6.

The Audi A4 after hitting the guardrail and starting it.

For this reason, among the arguments presented by the prosecutor and the complaint to refuse the domiciliary, they stand out that the defense "

did not present the

boy's

medical history

to support asthma and celiac disease, only medical certificates," the sources said.

They also added that they highlighted that he was driving

drunk and

without registration:

he had been detained for driving in his mother's car with the VTV expired.

"Therefore he

was disabled to drive

since October 2020 and did not initiate the process to recover it," highlighted the sources consulted.

Also, that early morning

Duhalde Bisi violated the

restrictions due to the

coronavirus

pandemic

, a cause that is processed in the federal jurisdiction, and was driving

high speed

, although even how far the Audi was going that morning has not been able to be determined.

The tragedy

The accident occurred on Camino de los Remeros and Avenida Santa María, in Rincón de Milberg, when the young man lost control of his father's Audi A4,

collided with the guardrail

and then against a metal column.

In the car, in addition to the detainee and Rossi and Alimonda, who died as a result of the injuries caused by the entry

of the 25-meter-long guardrail

to the car -and that crossed it from right to left-, there was also a fourth friend: Mateo Lezama (18) who suffered minor injuries like Duhalde Bisi.

The accident was on the Camino de los Remeros in Tigre.

That night of May 8, Alimonda, Lezama and Rossi arrived with

a fifth friend

at Duhalde Bisi's house.

They drank beer and played ping pong, according to sources in the case.

That fifth friend, whose name did not transcend, got into his car after 2 on 9 May and

went home to sleep.

"The next day I had to work," the sources described.

Joaquín Alimonda (19) and Franco Rossi (18) died on the spot.

And they added that, before going to work, he had to pick up Alimonda, Rossi and Lezama at Duhalde Bisi's house "

to take them home

."

The truth is that the friends stayed at the Duhalde Bisi family house until, around 4 o'clock, they got into the Audi A4 and left.

A while later the tragic accident would occur.
