Victoria Donda, head of the National Institute against Discrimination, Xenophobia and Racism (Inadi), was dismissed by federal judge Sebastián Casanello in the case in which an official was accused of committing the crime of fraud against the Public Administration.

The magistrate determined that

the official did not incur a legal offense

after being denounced in December 2020 by

Aminda Banda Oxa

, who assured that the former deputy

had offered her a position at INADI or a social plan

in exchange for her resigning her job. in his house.

According to the plaintiff, it all began when Banda Oxa ordered Donda to

pay back contributions owed and to regularize their contractual relationship

Casanello concluded that there was no crime after investigating whether at any time

administrative procedures

had

begun

for an alleged appointment of Banda Oxa in the anti-discrimination institute.

According to the magistrate, during that process no indication of the offer made was found in the audios that went viral, not even preparatory acts for a possible hiring.

Nor was there evidence of any ongoing process to grant a social plan or a similar subsidy.

The judge in charge of the case also appealed to the Office of Administrative Investigations, which investigates disciplinary offenses of public officials, to corroborate whether there was any action against Donda, without affirmative results.

The decision adopted by the Justice does not prevent Donda from being investigated in the future for violating some of the obligations inherent to his function, established in article 3 of the public ethics law.

Nor does it limit or call into question the claim made by the domestic worker in Labor Justice.

The resolution only determines that the attributed conduct is not a criminal offense.

From the decree to the opinion with a wink


In June, through a decree, President Alberto Fernández ratified Donda as the organism's auditor for another 180 days.

In July 2021, after the controversial statements of the President about the origin of Brazilians, Mexicans and Argentines, Donda issued a favorable opinion to Fernández, accused of “racism”, highlighting his link with the former president of Bolivia, Evo Morales, and strong criticism of Mauricio Macri.

On that occasion, where he argued that the sayings "do not reflect the actions of the Fernández government, which, far from promoting discrimination and the invisibility of native peoples, intensely promoted the equality of historically vulnerable groups."

And after listing some measures, he pointed to Mauricio Macri.

He referred to a 2004 law that was "an interruption" of a "founding" idea that violated the basic rights of native peoples and migrants, among others.

The rule, Donda said, was modified in 2017 by the former president, whom he accused of "re-associating Latin American migration with crime and considering the foreigner as a danger."
