Ma Jialin is a Canadian national, and has served as the Chief Justice of Canada, the Chairman of the Canadian Judicial Council, the Chairman of the Advisory Committee of the Order of Canada and the Chairman of the National Judicial Academy Council.

In 2018, she was appointed by the Chief Executive as a non-permanent judge in the common law jurisdiction of the Final Court.

After the Hong Kong National Security Act came into effect last year, two non-permanent judges of the Court of Final Appeal have left their posts, namely James Spigelman of Australia and Lady Brenda Hale of Britain.

Some foreign media respectively quoted news saying that Shi Juemin's departure was related to the National Security Law, while He Xiyi had doubts about the implementation of the National Security Law.
