Since the community center was closed anyway because of the lockdown, Haar would not have suffered any loss of rent, said the community spokeswoman.

Mayor had "violated his duty to provide information to the municipal council"

A decision to open the test station has not yet been made in the municipal council, but the committee had been informed.

"The mayor informed the council about the transfer of use, but not that it was free of charge", criticized SPD man Gantzer in his letter of complaint to District Administrator Christoph Göbel (CSU).

Bukowski had thereby "violated his duty to inform the local council", the letter goes on to say.

In general: The town hall chief is not responsible for the conclusion of free contracts.

This results from the municipal code, which Bukowski himself decided.

The main committee alone has this competence, argues Gantzer.

He never decided on the loan agreement.

Donation at the expense of the municipality?

The municipal administration replied that at that time another test option urgently had to be created: “The motivation for the rapid implementation of the test station in the community center was solely for the good of the citizens of Haar,” said the municipality spokeswoman.

The former notary Gantzer disagrees: There was no urgency because there was the test center on Wasserburger Strasse (B 304).

The SPD local council emphasized that there would have been enough time to deal with the matter with the main committee.

In addition, with a view to the municipal budget, it is advisable to rent the rooms for a fee.

The “donation” was “at the expense of the municipal budget”, according to Gantzer, while the operator earned “golden eggs”.

The district administrator's answer is still pending

If his decisions are contradicted, the mayor reacts like “a mimosa”, writes Gantzer.

Despite previous disputes: The complaint is not politically motivated, he assures.

According to Gantzer, the facts would be sufficient to “carry out a procedure under the Bavarian Disciplinary Act”.

An answer from District Administrator Göbel is still pending.

But it should be exciting next Tuesday, July 20th.

Then the Haarer main committee will vote on the retroactive granting of the free transfer.

It is not the first time that Mayor Bukowski and SPD councilor Gantzer have clashed.

The town hall chief has already filed a criminal complaint against the social democrats, but withdrew them again.
