- Four years ago, a senior citizen fell while cycling on the Isar cycle path.

A Labrador suddenly shot into the wheel of the now 77-year-old.

“I completely fell on the dog with my bike”, the woman recalled on the sidelines of a trial before the district court in Munich I. There, together with her Ismaning lawyer Wolfgang Weber, she had sued the dog owner for compensation for pain and suffering.

While the dog was able to get out of its predicament quickly, the elderly woman was left with a broken wrist and thumb.

She felt sick with pain.

The owner quickly explained to her that she was highly insured.

And in fact, the question of liability was immediately answered in the affirmative.

Because the Labrador should have been on a leash.

Until the moment of the accident, however, he had been walking well next to his master and mistress.

This was also confirmed by the extremely sprightly 77-year-old.

When she drove down a small hill between Garching and Ismaning, she saw the "walker group" from afar.

The dog was with his people, explains the plaintiff, who came to court with her partner and son.

The two men should have testified as witnesses.


Judge suggests settlement

But it didn't come to that. The judge proposed a settlement to both sides - and began to calculate. The 77-year-old had claimed 5,000 euros in compensation for pain and suffering and set up household management damage of around 1,500 euros. She also demanded that all follow-up costs from the hand injury be taken over. She is still wearing a splint because of the fracture, which did not require surgical treatment.


The dog owners' insurance paid 4,000 euros in compensation for pain and suffering and took over 1,000 euros of the household costs.

The judge suggested "selling" the consequential damage claim.

That is legally legitimate.

For this he suggested 1,500 to 2,000 euros.

The insurance company only approved 1,500, the plaintiff's lawyer demanded 2,000. Now it must be checked whether the total amount of 3,500 euros will be covered.

The withdrawal period runs until August 3rd.


The 77-year-old can now ride a bike again, but many other things are not possible.
