A number of Sham Shui Po District Councillors were concerned about the incident and submitted documents to the District Council earlier, requesting the Environmental Protection Department to step up law enforcement on the noise problem of shops on Ap Liu Street.

In the document, they pointed out that in a section of Ap Liu Street outside the exits A2 and C2 of MTR Sham Shui Po Station, there are several shops selling telecommunications products with loudspeakers, and the continuous noise makes the nearby residents miserable.

They also pointed out that according to the Noise Control Ordinance, it is illegal to use loudspeaker devices to operate businesses in public places and cause annoyance by making noise. Only when residents have called for help on noise problems, the noise problem falls within the scope of the Environmental Protection Agency’s enforcement. The police can only give verbal persuasion to the shop when they are there to follow up. Therefore, they urged the Environmental Protection Department to step up law enforcement and restore the quiet life of the residents in Sham Shui Po.

The reporter inspected the site today (22nd) and saw that in the afternoon, there were crowds and hustle and bustle in the area of ​​Apliu Street, and the salesmen of the shops used ear-mounted microphones to turn on the microphones to sell to passers-by for watching TV. In a written reply, the Environmental Protection Agency stated that it will send law enforcement officers to the scene to assess the noise after receiving the relevant complaint.

The law enforcement officers will consider the actual situation at the time, including the location of the complainant, the surrounding environmental sound, the level and characteristics of the noise, and the continuous and repeated situation of the noise, etc., to assess the noise situation of the store from a reasonable person's perspective.

If law enforcement officers determine that the noise is annoying to nearby residents or businesses, further enforcement actions will be taken in accordance with the aforementioned regulations.

A total of 62 related noise complaints were received in the past year

From June 2020 to May 2021, the EPD received a total of 62 complaints about noise caused by the use of loudspeakers in shops near the A2 and C2 exits of the Ap Liu Street MTR Station in Sham Shui Po.

In response to the persistent use of loudspeakers in shops along Apliu Street, the department has also stepped up enforcement actions during the above-mentioned period. A total of 83 active or follow-up inspections have been conducted, and two shops on Apliu Street have been successfully prosecuted for violating the Noise Control Regulations.

The two shops were convicted and fined in Kwun Tong Magistracy in June 2020 and April 2021 respectively.

The Environmental Protection Department also emphasized that in addition to continuing to send personnel to strengthen inspections around the site, it will also conduct joint enforcement actions with relevant departments from time to time to combat noise nuisance caused by the use of loudspeakers in shops to nearby residents.
