Joaquín Duhalde Bisi
, the 19-year-old driver who was driving drunk and without registration, when he collided with an Audi A4 and killed two friends in Tigre, was benefited by Justice with
house arrest
,
sources with access to the file
confirmed to
Clarín
.
This was decided this Friday by the San Isidro Guarantee Judge No. 5, Diego Martínez, after he asked the defense to present Duhalde Bisi's medical history and studies confirming his pathologies, during a hearing held in a week.
During the same hearing, the driver, who has been in prison since the accident, which occurred on May 9, was sorry for what happened and
apologized to the relatives of Franco Rossi (18) and Joaquín Alimonda (19).
Joaquín Alimonda (19) and Franco Rossi (18) died on the spot.
Duhalde Bisi is charged with double manslaughter aggravated by the plurality of victims, speeding, and alcohol consumption.
Now he
will fulfill domiciliary in the house
that his parents have in the El Amanecer neighborhood, near where the accident occurred.
In order to request that the detention conditions be reduced, the defendant's defense had argued that
the young man is celiac and suffers from asthma.
This week, the records were presented by the Justice and hence the judge's ruling.
It must be remembered that Franco Rossi's mother, represented by Madres del Dolor, as well as the prosecutor Sebastián Fitipaldi had
opposed
the domiciliary.
Alimonda's family, on the other hand,
agreed
that Duhalde Bisi be sent home.
Joaquín Duhalde Bisi is 19 years old and is in custody.
The driver who, drunk and without registration, crashed his father's Audi A4 on the Camino de los Remeros in Tigre is being detained at the Villa La Ñata police station.
It is very likely that the lawyer for the Rossi family will
appeal
Judge Martínez's measure to lessen the conditions of detention for the driver.
The cause
With respect to the file, it remains to be seen the result of the
accident investigation
to determine how fast the Audi was driving at the time of the crash.
Alimonda, Duhalde BIssi - the driver and Rossi were friends.
That tragic dawn, Duhalde Bisi
violated the restrictions due to the
coronavirus
pandemic
, a cause that is processed in the federal jurisdiction, and was
driving the high speed
, although it is not yet known how far he was going.
The accident
occurred on Camino de los Remeros and Avenida Santa María
, in Rincón de Milberg, in the early morning of May 9 when Duhalde Bisi lost control of his father's Audi A4, collided with the guardrail and then against a metal column.
In the car, in addition to the detainee, Rossi and Alimonda, there was also a fourth friend: Mateo Lezama (18) who suffered minor injuries such as Duhalde Bisi, who had
1.39 grams per liter of alcohol in
his
blood
and his record was retained by the VTV.
So was the Audi after the crash.
Hours before the accident, Alimonda, Lezama and Rossi arrived with a fifth friend at Duhalde Bisi's house.
They drank beer and played ping pong, according to sources in the case.
That fifth friend, whose name did not transcend, got into his car after 2 on 9 May and went home to sleep.
"
The next day I had to work,
" the sources described.
And they added that, before going to work, he had to pick up Alimonda, Rossi and Lezama at Duhalde Bisi's house "to take them home."
The truth is that the friends stayed at the Duhalde Bisi family house until, around 4 o'clock, they got into the Audi A4 and left.
A while later the tragic accident would occur.
