In Bavaria, inns such as pubs and bars are allowed to reopen their interiors for the time being.
The Bavarian Administrative Court (VGH) in Munich granted an urgent application from a landlady from Lower Franconia on Friday.
The corresponding regulation of the Infection Protection Measures Ordinance will be suspended for the time being, he explained.
According to the new corona rules that have been in force in Bavaria for about a month, pure pubs are not allowed to open their interiors, but restaurants with appropriate hygiene measures are.
As a result, the landlady saw her freedom of occupation and the general principle of equality violated.
The VGH agreed with her.
At the beginning of the pandemic, there were actually big differences in the typical operations between restaurants and pubs, he justified his decision.
In the meantime, however, "especially the increased consumption of alcohol during social gatherings" has come so close in many restaurants to what happens in bars that different treatment is no longer justified.
To combat the risk of infection in the pubs, milder means such as hygiene concepts or a ban on serving alcohol from a certain time onwards could be considered.
The closure of the interiors of pure pubs has been taking a long time and the encroachment on the freedom of occupation is therefore very difficult, the VGH explained.
