Drivers dissatisfied with life-long suspension of KMB’s 19 deaths in Tai Po, appeal court dismissed immediately

A KMB rollover accident occurred on Tai Po Highway three years ago, resulting in 19 deaths and more than 60 injuries.

The KMB driver involved pleaded guilty last year to 38 counts of manslaughter and dangerous driving causing serious bodily harm to others. He was sentenced to 14 years in prison and suspended for life.

He appealed the suspension order and applied for permission to appeal today (27th), emphasizing that he is a good and law-abiding citizen. At the time of the case, he was only wrongly convicted, not retaliation for being scolded by passengers.

After hearing the submissions, Judge Mai Jizhi of the Court of Appeal dismissed his application immediately.

Claiming to be a law-abiding citizen

The appellant, Chen Haoming, is not represented by a lawyer today. He personally stated that the case was wrongly convicted and that the bus overturned at an improper speed, not in retaliation for causing the bus to overturn.

Chen also emphasized that he was a good law-abiding citizen. In the 12 years from obtaining a driver's license to the incident, there was only one discipline for accidentally driving and was fined.

He was sentenced to 14 years in prison in this case, and he has enough deterrent power to remind him to drive more cautiously in the future.

The prosecution believes that a lifetime suspension is not excessive

The representative of the Department of Justice responded that the case is serious.

Before the incident, a passenger asked Chen not to drive too fast. The car's sirens also sounded, but Chen's dangerous driving lasted for a while.

A total of 67 passengers were injured in the case, of which 19 were seriously injured and 19 people were killed.

The prosecution believes that the life suspension of trading is not excessive.

The official said the public would not accept the recurrence of similar things

The judge pointed out that the suspension order takes into account the risks that the defendant poses to other road users.

The judge stated that although the passengers warned and the sirens on the car sounded, the bus driven by Chen was still driving at high speed, which eventually led to the incident.

The judge pointed out that the public did not accept the recurrence of similar incidents and decided to reject Chen's application.
