- "If we look at what would have come out in adult criminal law: We would not be sitting in Ebersberg, but in the district court of Munich", lawyer Florian Alte concluded his plea before the district court of Ebersberg on Tuesday.

His client: a 23-year-old Kirchseeoner who regularly sold drugs across the county borders for about a year and a half.

It has been proven that the young man sold cocaine and marijuana twelve times to adults between March 2018 and August 2019 and 22 times to young people.

Over 50 customers could be identified;

the amounts that were traded ranged between ten and 500 euros.

Judge Markus Nikol wanted to know from the defendant whether he knew that the customers were minors.

The 23-year-old explained that he was only contacted on his cell phone, so he didn't know who was calling.

“They all said they were 18 or older.” But he could have guessed some of them, he admitted when the judge asked.

The Kirchseeoner himself consumed heavily at the time.

“About two grams a day, on average,” he said in court.

He came to trading as well as consuming "very classically": someone asked if he could get something.

He said he had a contact by chance and passed on 0.5 grams less than he got for the money he received in advance.

"So he didn't make any financial profit from it, just the material," emphasized the defender.

He actually only wanted to satisfy his own addiction and did not earn any money with the business model, said the defendant.

At his home, too, he never kept large quantities that were intended for sale.

"The maximum I ever had at home was five grams."

This was also confirmed by a police officer who testified as a witness.

After getting up, the defendant took orders via text messages, then drove to Neuperlach for procurement, for example, and then delivered the drugs.

"I have to say that now," said the policeman in court: "Clever business strategy that makes it difficult to investigate."

The juvenile court assistance spoke out in favor of the accused: In his life there have been some breaks.

The 23-year-old has already had to move so often that he can no longer correctly reproduce the chronological order himself.

At the time of the crime, he was homeless and saw no prospects.

He just wanted to satisfy his own addiction.

In the meantime, however, the young man is in training to become a hotel manager and is now “finally able to develop perspectives”.

The Kirchseeoner himself admitted to still consuming.

But: “It annoys me.

It's getting in my way.

And somehow it just pulls me down. ”But he couldn't get rid of his addiction himself.

And to get help, "I just don't have the eggs," he said in court.

Judge Nikol's verdict was: One year and ten months probation.

As unanimously demanded by the public prosecutor and the defense, he stuck to the verdict in juvenile criminal law.

Although the 23-year-old already has a criminal record, he showed remorse in court.

His full confession and that he did not actively approach the young people in order to enrich himself with their addiction should be valued in favor of the Kirchseeoner.

"So that the accused can clearly see where his actions can lead him," he also ordered a week of permanent arrest.

The 23-year-old has to undergo outpatient drug therapy.
