Alberto Fernández: 'Why can't the duration of the judges in their functions be put to an end?'

The President raised the possibility of discussing whether the magistrates should revalidate their status after a period of time, as discussed in the case of the Prosecutor.

During a meeting with law students, held this Saturday through a videoconference, President Alberto Fernández made

strong criticisms of Justice

and put into debate an idea that, according to him, generates controversy.

Asked about the possibility of judges being elected through popular vote, the President maintained that he is not in favor of this initiative, but said that he would like to

discuss the time in which judges remain in their positions. 

"I am not concerned that judges continue to be chosen as they are chosen. What we could see are some concepts. For example, the concept that is being discussed in the Senate and that is being discussed about the chief prosecutor, about the Prosecutor. Does the Prosecutor have a lifetime position or should he last a while? And we should ask the same question regarding the judges. Because in truth, I shouldn't say it because I know that I am going to open a controversy, but I am speaking with law students and the best way to teach is to sow doubts, "he said.

On the current regulation, he pointed out. "The Constitution says that the judges will last in office as long as their

good conduct

lasts

. The same says of the President of the Republic, the vice president, the deputies and senators, and the ministers. Now, just as we can say that the Procurator must last in his mandate X number of years and then he must renew his appointment, the same can be said of the judges.

One can say that a judge is appointed for 10 years and after 10 years he must revalidate his status as judge

. it is something not regulated. What is not said in the Constitution is that judges are judges until their death, "said Fernández.

And he added: "If the Attorney General can be put to a term, why can't the duration of the judges in their functions be put to an end?"

On the controversy that the project can generate, he anticipated: "I know that it is to open a difficult, complex debate. I am not proposing to do it now, I am reacting to a question that tells us why we do not elect the judges, but I believe which are all issues for us to think about, for us to debate how to build a better Justice service ".
