The Independent Commission Against Corruption today (2nd) sued Ou Nuoxuan and singer Huang Yiu-ming, candidate for the Hong Kong Island Geographical Constituency in the 2018 Legislative Council by-election, accusing the two of suspected of committing fraud in the election and providing entertainment to others to induce others to vote. The ICAC received a complaint earlier, alleging that someone was suspected of violating the "Elections (Corrupt and Illegal Conduct) Ordinance" and launched an investigation. After consulting the Department of Justice, he was sued Ou Nuo Xuan, 34 years old, in the 2018 Legislative Council by-election in Hong Kong Candidate for the Island Geographical Constituency, and Huang Yaoming, 59 years old, singer.
Ou Nuoxuan and Huang Yaoming were charged with a fraudulent act of providing entertainment to others in an election, violating section 12(1)(a) of the Election (Corrupt and Illegal Conduct) Ordinance.
The two will defend themselves in the Eastern Magistracy this Thursday (5th).
The charges allege that Ou Nuo Xuan and Wong Yiu Ming were suspected of committing fraud in the Hong Kong Island Geographical Constituency in the 2018 Legislative Council by-election on March 3, 2018, that is, providing entertainment for another person to induce the other person to vote for Ou Nuo in the election. A few hours before the rally, Ou Nuoxuan posted another post on his social platform, announcing that Huang Yaoming will perform at the rally.
During the rally, Huang Yaoming sang two songs on stage.
At the end of the performance, he appealed to those present at the rally to vote for Ou Nuoxuan in the above election.

The ICAC investigation found that on March 4, 2018, Ou Nuoxuan’s social media page shared a short video of the rally, including Huang Yaoming’s performance and his appeal to those attending the rally.
Ou Nuoxuan declared the relevant video clip and the post announcing that Huang Yaoming would perform at the rally as his election advertisement.
The Registration and Electoral Office provided full assistance during the investigation of the ICAC.
Section 12 of the Election (Corrupt and Illegal Conduct) Ordinance stipulates that any person provides food, drink or entertainment for another person, or reimburses all or part of the cost for providing such food, drink or entertainment in order to induce the other person. One person or a third party who votes or does not vote for a certain candidate or certain candidates in an election is a fraud.
An ICAC spokesperson emphasized that providing refreshments and entertainment to others during the election is fraudulent and a serious crime.
The ICAC reminds candidates, election agents/election helpers and the public not to provide food, drinks or entertainment in exchange for votes in the election.
Regarding the upcoming public elections in the next few months, the ICAC has launched a series of diversified education and publicity activities to promote a clean election culture and help stakeholders understand the provisions of the Elections (Corrupt and Illegal Conduct) Ordinance.
The ICAC will use election briefings and forums, reference materials compiled for candidates, election agents/election helpers and voters, lectures and activities for voters from different sectors, and various publicity platforms such as media and social media.
