The Judiciary announced today (2nd) that a two-tier mechanism for handling complaints against judges and judicial personnel will take effect on the 16th of this month. The committee consists of 9 members and will serve a two-year term after the new mechanism.

The Chief Justice of the Court of Final Appeal Zhang Juneng is the chairman of the committee. The remaining 8 members, 5 people from the legal profession, and 3 members of the public, including Dr. Cheng Weizhi, Liu Yanqing and Professor Li Zhuofen.

The committee is chaired by Zhang Juneng, and 5 persons from the judiciary, including 4 judges and 1 Senior Counsel: Judges Lin Wenhan and Chen Zhaokai, Permanent Judges of the Court of Final Appeal, Chief Justice Pan Zhaochu of the High Court, and Judge Guan Shuxin, Deputy Chief of the Court of Appeal of the High Court , And Senior Counsel Feng Bodong, and three other people from different sectors, including: Wing Tai Real Estate Co., Ltd. Chairman Dr. Zheng Weizhi, Hong Kong Breast Cancer Foundation Director-General Liu Yanqing, and Co-Constructing Victoria Harbour Committee Chairman Professor Li Zhuofen.

Five of the committee members are judges.

Chief Justice Zhang Juneng of the Court of Final Appeal stated that judicial independence is protected by the Basic Law.

When implementing a two-tier mechanism to handle complaints against the conduct of judges and judicial personnel, the basic principle followed by the judiciary is not to weaken the independence of the judiciary.

Any dissatisfaction with judicial decisions can only be handled through applicable legal procedures, such as appeals or reviews.

He also pointed out that the members of the advisory committee include senior judges and members of the community from different sectors. The terms of reference of the advisory committee are as follows: (1) Supervise and advise on the handling of complaints against judges and judicial personnel; (2) Identify areas that cause or may lead to complaints in court routines/procedures, and propose appropriate improvements Suggestions; and (3) Make suggestions on improving the complaint handling mechanism.
