Covid-19: the law on the extension of the health pass promulgated

The validation of the Constitutional Council represented the last obstacle to the extension of the health pass.

It was lifted Thursday afternoon, when the Constitutional Council broadly validated the device.

The new law relating to the management of the health crisis was therefore published this Friday in the Official Journal.

It will come into force on August 9.

Are thus accessible on the condition of presenting a health pass “the leisure activities;

commercial catering or drinking establishments, with the exception of collective catering, take-away sale of prepared meals and professional road and rail catering;

trade fairs, seminars and trade shows;

long-distance travel by interregional public transport;

department stores and shopping centers ”.

A law applicable until November 15

In addition, the law promulgated, applicable "until November 15, 2021 inclusive", also provides for an obligation to vaccinate for caregivers and other professions in contact with vulnerable groups.

They have until October 15 to present a complete vaccination schedule.

The text specifies that when an employee subject to the obligation of vaccination status against Covid-19, such as caregivers or restaurant employees for example, does not present the proof of vaccination or negative PCR test, "and s' he does not choose to use paid vacation days ”, his employer will be able to suspend his employment contract the same day. “This suspension, which is accompanied by the interruption of the payment of remuneration, ends as soon as the employee produces the required supporting documents. "

The Constitutional Council nevertheless censured the early termination of contract of fixed-term contracts or temporary workers without a pass.

Also censored, the compulsory isolation of patients for 10 days, considered disproportionate, as well as the obligation to present a pass in health establishments for treatment.

On this point, the Constitutional Council considers that the health pass cannot be requested only for accompanying persons and visitors.

The law promulgated provides that "the National Assembly and the Senate may request any additional information within the framework of the control and evaluation of the measures" introduced.

The health pass in force since July 21, by decree, was in places of leisure and culture bringing together more than 50 people.

Except for 12-17 year olds, exempt until September 30.
