- The accident happened on February 18, shortly after 6 a.m. in Sachsenkam: On the driveway to federal highway 13, an Audi driver (24) collided with an oncoming cyclist.

The man broke his facet joint on his seventh cervical vertebra.

A laceration on the skull had to be sewn with 21 stitches.

In addition, the Sachsenkamer (54) suffered a torn tendon on his left thumb and various bruises.

The driver was sentenced to a fine totaling 2,100 euros for negligent bodily harm.

He appealed against this, which is why the parties now came together in court.

The road was difficult to see in the section, said the defendant, who came from work that morning and was on his way home to Lenggries.

"I just didn't see him - then I caught him," he admitted his fault.

Sachsenkamer (54) suffered from the consequences of the traffic accident for a long time

Contrary to the accused's testimony, the injured party claimed to have been wearing reflective clothing that morning. "I saw him coming, he must have seen me too." The cervical spine injury had resulted in a total of seven weeks of rehab. To this day he goes to occupational therapy and is also receiving psychotherapeutic treatment. "It has improved, but it has not yet been restored." Despite the considerable consequences, he had not filed a criminal complaint against the 24-year-old. "That is commendable," emphasized the judge. “He didn't do it on purpose. He apologized, I accepted, ”said the witness. "I just wanted it to be handled properly." To date, the insurance company has only paid an advance of 3,000 euros on the treatment costs.

Defense attorney Arnulf Kowalski, who had gone into the hearing with the aim of obtaining a suspension of the proceedings against payment of a monetary condition, seized the opportunity.

He suggested that his client should pay the injured party the amount of 2100 euros stipulated in the penalty order as a contribution to the reparation of the damage.

The prosecutor went with me.

Judge Helmut Berger then suspended the proceedings for the time being.

It is definitely off the table for the accused when the accident victim confirms receipt of payment to the court.
