The dispute over the development of the Kreuzlinger Feld continues in court.
The Bavarian Administrative Court has accepted the action brought by the citizens' initiative “Livable Germering” against the rejection of the referendum.
Germering
- The approximately ten hectare Kreuzlinger Feld between the railway line, Kreuzlinger Straße, Alfons-Baumann-Straße and Starnberger Weg, is one of the last large undeveloped areas in the city.
Shortly after the first concrete planning for a development became known almost three and a half years ago, resistance arose.
The resulting citizens' initiative "Livable Germering" ultimately decided to initiate a referendum in order to prevent what they consider to be too massive development.
The necessary quorum has been achieved.
Over 2,800 signatures were handed over to the city in June.
The associated goal of holding a referendum on the future of the Kreuzlinger Feld, however, was not achieved.
The city council rejected this by a majority.
Reason: A legal report commissioned by the city found that the question in the referendum was not clear.
The citizens do not want to be satisfied with that. As announced, BI is taking legal action. "Already from the obligation to the citizens who have signed the petition," it says in a statement. A filed suit has now been accepted by the Bavarian Administrative Court. The BI assesses the further procedure as follows: "So now an independent court will decide how to proceed and not the citizens for the time being."
In the communication, the representatives of the BI repeat once again why they are fighting “for a sensible and sustainable development”.
Among other things, this should preserve the existing fresh air corridor for the city center and significantly reduce the sealing of almost 80 percent of the total area of the area.
Instead of planning optimized to the needs of investors, BI also calls for concepts for the challenges of climate change.
The recent extreme weather events have painfully demonstrated that some of the demands are topical.
