Climate law: the Sages reject the appeal of the deputies, without commenting on the merits

2021-08-13T16:42:42.026Z

The Constitutional Council deemed too "general" the grievances for which it was seized by sixty left-wing deputies on the climate law.

The Constitutional Council, in particular seized by deputies on the climate-resilience law, dismissed Friday, August 13 "

as excessively general the grievances before it

", but without commenting on the compliance of the law with the Constitution.

"

The appeal challenged the law taken as a whole

", judging that it was part of "

the spiral of inaction which led to non-compliance with France's trajectory in terms of reducing greenhouse gases

" and does not guarantee "

the right to live in a balanced environment which respects health, enshrined in Article 1 of the Environmental Charter

", the Constitutional Council recalls in a press release.

"

The applicants only develop a general criticism (...) of the insufficiency of the law taken as a whole and therefore do not criticize, in order to request censorship, any particular provision

", notes the press release, which indicates that the Sages could therefore only rule out this recourse. There is now the possibility of challenging different articles of the law through the procedure of the priority question of constitutionality. “

The Constitutional Council deduces that their grievance can only be dismissed.

"

Once the law is in force, there will remain the possibility of contesting its content via the procedure of the priority question of constitutionality (QPC). This law, inspired by the work of the Citizen's Convention for the Climate (CCC), associated with other texts and the recovery plan, will allow France to fulfill its commitments and "

move towards the -40% target

" greenhouse gas emissions by 2030 compared to 1990, the government assured when it passed Parliament on July 20.

But for PCF, LFI, PS deputies who had seized the Constitutional Council, and NGOs, the account is not there.

The High Council for the Climate (HCC), an independent body responsible for evaluating France's climate policy, also notes that France is not on the right path to reduce its greenhouse gas emissions and thus fight against climate change.

The Council of State ordered the government in early July to do more to meet its greenhouse gas reduction commitments.

Seized by the municipality of Grande-Synthe and several associations, he gave him until March 31 to review his copy.
