The National Electoral Chamber on Thursday reversed a ruling of the processed federal judge with electoral competence of Mendoza Walter Bento and ordered that it
be issued on the pre-candidacy of Governor Rodolfo Suárez as the first alternate for national senator on the Together for Mendoza list of the Alianza Cambia Mendoza.
In this sense, it ruled that until the substantive issue is resolved by means of a ruling from the chamber, it
be suspended
for the grouping of the Mendoza governor "of the acts subsequent to the formalization of the pre-candidacies, such as the presentation, printing and distribution of voting ballots. "

Bento
had rejected
Monday the challenge that the Frente Vamos Mendocinos made to the candidacy for alternate national senator of the radical governor Rodolfo Suárez, of the official alliance Cambia Mendoza, led by the UCR and the PRO.
The questioned magistrate - tried and put on trial as the alleged head of an illicit association and accused of collecting bribes in exchange for favors to prisoners - rejected the presentation based on law 26,571 referring to the PASO primary elections, considering that

In this sense, article 28 of the law indicates that "the resolution of the Electoral Board of the group can be appealed by
any
of the lists of the group itself", for which Bento interpreted that "the alliance 'Vamos Mendocinos' ( composed of several parties, led by the Democrat) is
not entitled
to question the candidacy for alternate national senator of Mr. Rodolfo Suárez ".
Vamos Mendocinos is made up of the Democratic Party (PD);
the Civic Coalition (CC);
MendoExit;
Mendoza Wake Up;
Servir, UnidosMza and the Cities in Action Party.
The judicial process, presented by Aldo M. Vinci, representative of the Frente Vamos Mendocinos, before the Electoral Board, requested the
"challenge
as a candidate for Alternate National Senator of Mr. Rodolfo Suárez" because they assure that the governor "is
disqualified
to appear for such charge by art. 115 of the Constitution of the Province of Mendoza ".
This article
prevents
the reelection of the governor and also establishes that the provincial leader "may not be elected as a national senator until
one year after
having finished his term."
The reversal of this ruling increases the tension between Bento and the national electoral chamber.
As this newspaper announced last week, the highest court in the matter had suggested to the Mendoza judge that he request a license until his procedural situation is clarified.
But Bento turned it down.
The Magistracy Council opened an investigation against Bento in the Discipline and Accusation committee led by PRO deputy Pablo Tonelli.
But as an expert opinion on his assets was requested for the complaint of illicit enrichment there will only be a commission opinion after the STEP of September.
Then the plenary of the Magistracy should approve the political start, which will allow its suspension until it is decided whether to dismiss or ratify him in office.
