The Saxon Higher Administrative Court (OVG) in Bautzen came to this decision on Friday in an urgent procedure. The deportation in June was therefore illegal. The reason: Two children between the ages of ten and eleven could be granted a right of residence under German law because they have been attending school for a long time and the associated integration.

If this occurs, the parents and siblings of the two children would also continue to have the right to tolerance in this case due to the existence of a family relationship, so the judges in their final decision - at least until the final decision on the applications of the school-age children for a possible one Residence permit.

According to the court, the asylum applications of the family who arrived in 2013 were finally rejected in October 2020.
