Dietramszell - A man with multiple criminal records had to answer to the local court for a violation of the Narcotics Act.
On June 20, 2020, police officers discovered 98 grams of legal CBD hemp flowers as well as 40 grams of the illegal drug cannabis on his terrace.
The defendant brought 18 previous convictions as a mortgage to the trial.
He has already been convicted of theft, trespassing, assault, fraud and drug trafficking.
"I wanted to use the hemp and cannabis as a tobacco substitute in order to be calmer and to be able to fall asleep at night," said the defendant.
ADHD since childhood
Because he has had ADHD since childhood, he even had a Wolfratshausen doctor prescribe cannabis flowers for inhalation in the fall of 2020.
Because his home-grown cannabis and hemp plants only had a low active ingredient content.
The fact that the police even rang his doorbell was due to the defendant's negligence.
"We went to see him because he hadn't come forward to a parole call," said one policeman.
Suspicious paraphernalia
In the house, he and his colleague came across utensils that indicated drug use.
The prosecutor demanded a seven-month prison sentence despite the low content of cannabis active ingredients.
Judge Helmut Berger, however, confirmed that the defendant had a positive social prognosis.
According to his own account, the 42-year-old now only takes care of his new partner and her toddler.
In addition, he will soon start a new job.
"I now stay away from everything and stay with my family after work," he promised.
Judge Helmut Berger finally suspended a six-month suspended sentence, as the defendant's last relevant preliminary conviction was many years ago.
