Two young women who spent time with Aviv Geffen and Lior Narkis last month at Live Park in Rishon LeZion filed a class action lawsuit against Zappa, after discovering that a third of the beer they ordered contained between 274 and 288 ml instead of 330 ml. The district centralizes a total of about NIS 6 million, through attorneys Nir Smogora and Ehud Geri.
The lawsuit alleges that Zappa misled its consumers in accordance with the Consumer Protection Act, the Contracts Act, the Torts Ordinance Act and the Wealth Making Act on the backs and accounts of customers.
According to them, this is also a violation of the Law of Measures and Weights, since in some of the glasses appeared the American-British size half a pint, which is prohibited for use in the country and the equivalent of 274 ml.
This is less than 330 ml, which is a third of a liter. Therefore, it appears that the beer glasses contain on average about 45 ml less, and the difference in content is more than NIS 4 per glass.
After the two realized that it was not a third of a beer, they decided to buy another glass and this time document the purchase on video.
The documentation states that they explicitly asked the bartender and it stated that it was a third of a liter and it poured them into a glass with the measure half a pint - about 50 ml less than the declared third, in fact only 85% of it. The two took the glasses to the pavilion The glass contains less than 300 ml.
Third Party
In the lawsuit, the two seek to order Zappa to sell their customers drinking glasses in which the displayed contents are identical to the actual contents, issue an order instructing Zappa to mark the capacity in liters and ml, issue a restraining order instructing Zappa to refrain from using the foreign unit of measure "Pint". The class compensation of about NIS 6 million for the damage.
Zappa Group responded: "Upon receiving the request for a lawsuit, Zappa turned to the bar service provider, which operates the bar in the complex, to check the allegations. We will respond upon receipt of the findings.
The bar's operator, Ruppin Bar, said: "We are examining the allegations and will respond in court."
