- The Bavarian Administrative Court in Munich has now issued a judgment in the dispute over the mask requirement for children from six years of age on Bavarian indoor playgrounds.

Accordingly, the rule that children from the sixth day of birth must wear mouth and nose protection in the facilities is valid.

It results from the 13th Bavarian Infection Protection Measures Ordinance, says the reasoning of the court.

Mask requirement on indoor playgrounds: judgment passed in Bavaria

The verdict was preceded by the action brought by the operator of an indoor playground in the Schweinfurt district.

A few weeks ago, they revolted against the requirements of the district office and demanded that children and young people between the ages of six and 15 should also be exempted from wearing mouth and nose protection.

In their application, the operators justified that it was alien to young children having to wear a mask on the trampoline, for example.

The administrative court in Würzburg had initially granted the application and granted permission that the mask requirement would only be due from the age of 16. The reason given by the administrative court was that the Infection Protection Ordinance only referred to "passengers", but that no rides could be found on the playground. The mask requirement also violates the principle of equality: It does not apply to fitness studios and other sports facilities that offer children comparable exercise. The Free State of Bavaria had filed a complaint against this judgment, it says on

The Free State of Bavaria is alone with this judgment.

In all other federal states, the obligation to wear mouth and nose protection in indoor playgrounds only applies to the adult accompanying persons - even if the children are older than six years.
