It should have happened during her student days: A man raped her.

Years later, she moved in with the same man.

After the breakup, she made the charge.

Now she has been convicted of defamation.

Wolfratshausen - "I was raped by him." This message, which she sent to a friend via Instagram, brought a woman from Wolfratshausen (39) to court.

The allegation, which was directed against a 40-year-old man from Schongau, could not be proven.

Therefore, the woman now had to answer for defamation.

She lived with the man - and only later realized that he was the rapist from her student days.

In court, the defendant asserted: "This abuse took place in the past." However, the act was eleven years ago. Back then, in 2010, she was studying in Munich. She described in detail to the court how the man with whom she had a brief relationship had forced sexual intercourse against her will. At that time, she did not report the incident because there were no more traces after showering. In the course of time she "pushed the matter aside" - until she contacted the mechanical engineering company from Schongau via a dating portal in the spring of 2018. At the first meeting she did not recognize him immediately, it was only later that she realized that the man she lived with for a few months last year was the rapist from her student days.

In front of the police, the woman sticks to her version

This is what she said to the police.

However, she was already questioned as a suspect by the officers.

The Schongauer reported the woman when he found out about the Instagram message after she moved out of his home.

In his testimony, the 40-year-old asserted that he only met the defendant three years ago on dating sites.

She has named many witnesses, but no one has been able to confirm her statements.

Everyone said it was all fake.

Detective officer

The police officer who investigated the alleged rape said, “She has named many witnesses, but no one has been able to confirm what she said.

Everyone claimed that all of this was haunted. ”A witness who the defendant claims to have met in the stairwell after the incident in Schongau testified that she had never been to Schongau.

The defendant was "still convinced today that she was raped," said the policeman, "but it rarely happens that it can be so easily refuted."

Defendant does not understand why she should be punished

The woman, who has not been guilty of anything criminally so far, said: “I have not committed anything.

I don't understand why they want to punish me. ”After all, despite their accusation, the man did not experience any disadvantages.

The prosecutor explained it to her: "Anyone who claims an undetectable fact is liable to prosecution."

Rape is the worst that could happen to a woman, the prosecutor said.

“But it is just as bad to accuse others without being able to prove it.

A false rape charge can destroy a man's existence. ”The accused's submissions, the prosecutor continued, were so full of contradictions that she believed“ that the rape did not take place ”.
