Report: 26% increase in complaints about the State Attorney's Office | Israel Today

The State Representatives Commission on the courts has published a document indicating a series of failures concerning the State Attorney's Office and the police prosecution system • A quarter of the complaints filed were found to be justified


The Ombudsman for Public Complaints on State Representatives in Courts, Judge (Retired) David Rosen, submitted the annual report of the State Representatives Commission on Courts last year to Justice Minister Gideon Saar and Attorney General Avichai Mandelblit.

The report shows a series of failures concerning the State Attorney's Office and the police prosecution system: during 2020, 898 applications were submitted to the Commission and 94% of them were completed that year. This is a 26% increase in the number of complaints filed in 2019. Justified.

Of these complaints, 46% were accompanied by operational recommendations on their side.

It also appears that the first response to the complainant was given in less than two days on average and the time for clarifying the complaint was one month.

In 92% of the complaints, decisions were made within less than three months of its filing.

Of the justified complaints, about 68% referred to the State Attorney's Office, about 17% referred to the police, including the police prosecution and the conditional settlement unit.

About 10% referred to plaintiffs holding a certification or power of attorney on behalf of the Attorney General. About 4% referred to the Attorney General.

About 1% referred to plaintiffs from the Disciplinary Division of the Civil Service Commission.

The Minister of Justice, Gideon Saar, said at the publication of the report: "As great as the power and authority entrusted to a public servant, so is their responsibility and duty to stand up to the public, whom they serve, and give an account, transparency and clean hands. It should be emphasized that the purpose of the audit is not to harm the status of state representatives in the courts, but on the contrary - to strengthen, improve and correct those in need of correction in their work and on the other to strengthen public trust, present to see that there is an independent and objective body. "Since the law was enacted, by virtue of which the Commission operates, much experience has been gained, and the need to strengthen the Commission and the tools available to it in its work has been illustrated."

Attorney General Avichai Mandelblit also commented, saying: Israel, and hence it is of great importance to improve our work, to identify deficiencies and correct them. "Rosen works with great professionalism and efficiency to conduct a constructive and factual audit, which strives to correct deficiencies and failures that are revealed in our work.
