The defendant Fu Shen (41 years old) was charged with six counts of using documents by an agent with intent to deceive his principal, violating section 9(3) of the Prevention of Bribery Ordinance.

The defendant was an Acting Senior Executive Officer at the time of the case. He was stationed in the Wong Tai Sin District Office of the Civil Affairs Department and was responsible for providing secretarial support to the Wong Tai Sin District Council. It is estimated that his monthly salary was 74,000 yuan.

According to the Civil Service Regulations, civil servants can leave their jobs during office hours and go to clinics to receive approved treatment, examination or consultation services.

If civil servants of the Civil Affairs Department apply to leave their jobs during office hours in accordance with relevant regulations, they should first obtain approval from their supervisors and fill out the application form after returning to work.

Among them, I arrived at the Chinese medicine clinic in the evening on the 5th and never arrived on the 1st.

The charge alleges that the defendant allegedly used six “leave job” application forms containing false or misrepresentations with intent to deceive her principal, stating that she had used six “leave work” application forms between November 30, 2018 and June 17, 2020. In the afternoon of six days, she went to a Chinese medicine clinic for consultation and treatment, and she knowingly intended to mislead the government.

The ICAC investigation found that the defendant had visited the Chinese medicine clinic in the evening on five of the above-mentioned days, and had not been there for the rest of the day.

The defendant was alleged to have attended an interest class in the afternoon of the six days involved.

The ICAC earlier received a corruption complaint referred by the Civil Affairs Department and launched an investigation. After completing the investigation, it sought legal advice from the Department of Justice, and prosecuted the Acting Senior Executive Officer based on the relevant legal advice.

The Civil Affairs Department provides comprehensive assistance during the ICAC investigation.

An ICAC spokesperson said that the agency attaches great importance to the integrity of civil servants.

The ICAC has cooperated with the Civil Service Bureau to provide integrity training and online learning platforms to government officials at all levels to enhance their understanding of the "Prevention of Bribery Ordinance" and related integrity issues.

The ICAC will continue to work with policy bureaux and government departments to promote a culture of integrity to civil servants.
