The male defendant Xu Weiwen, 47, was a director and shareholder of the closed Futeng Environmental Technology Co., Ltd. (Futeng); the female defendant Huang Cuiting, 33, was an assistant at the time of Futeng. Both were convicted of conspiracy to defraud. become.
According to the case, the Environmental Protection Department has been implementing a Cleaner Production Partnership Program since April 2008, which provides subsidies to Hong Kong-owned factories in Guangdong and Hong Kong to encourage and assist them to adopt cleaner production technologies and operating methods.
The Productivity Bureau is the implementing agency of the plan.
Those who apply for the program must abide by the relevant procurement rules. For example, the total value of the procurement project is more than 50,000 yuan but not more than 1.43 million yuan, and at least 5 suppliers’ written quotations must be obtained.
At Xu’s suggestion, a printing company hired Futeng to install an environmentally friendly air-conditioning system, and applied to the Productivity Bureau for funding, which was submitted by Huang via email. The Productivity Bureau received an application from the printing company in July 2014 with an amount of 300,000 Yuan.
Xu instructed another Futeng employee in October 2014 to submit a Futeng quotation and four false quotations from four other engineering companies to the HKPC.
And these false quotations show that Futeng's quotation is the lowest.
The HKPC believed it was true and approved the grant in December of the same year.
After the installation of the air-conditioning system was completed, 290,000 yuan was granted to the printing company in August 2016.
After investigation, the ICAC found that none of the four engineering companies mentioned in the application documents had prepared or issued the four quotations.
The fake quotations were prepared by Huang and Xu et al.
