For Sarah B. (15, name changed) from Penzberg, it should be a nice day in the climbing garden in Bad Heilbrunn.

But after a crash and serious injuries, the excursion is now being continued in front of the Munich II district court.

Penzberg / Bad Heilbrunn -

Together with her friend and other young people, the Penzberg student went on an excursion to the Penzberg youth center on October 14, 2017.

It happens on the third climbing route: Sarah B. fell and was seriously injured.

She broke both ankles and her left kneecap.

The 19-year-old student and her parents see the blame on the city of Penzberg (Weilheim-Schongau district) and the responsible supervisor.

These would have violated their supervisory duties.

The young woman is therefore claiming damages and compensation for pain and suffering in the amount of 18,000 euros before the Munich II regional court.

In addition, the determination that you will have to pay for future damage from the accident.

Indictment: Organizers had neither checked climbing skills nor health aptitude

The complaint states that the organizers had neither checked the climbing skills nor the health of the young people. Sarah B. formed a climbing team together with her friend. And this was immediately sent to lead climbing without any prior knowledge, where you had to repeatedly hook in the carabiner yourself. The climbing supervisor did not observe the girls either, so the allegation.

After two climbing routes, the 15-year-old was exhausted.

Nevertheless, a third route had been agreed with the supervisor.

On this she then left her strength.

She couldn't hook herself up anymore and fell.

Her feet hit the rocks and broke several bones.

She was in the hospital until the end of October, then spent two months in a wheelchair to go to rehab again.

Nevertheless, the damage remains permanent and the risk of osteoarthritis is increased.

It is maddening to say the two were not trained.

Climbing supervisor

The climbing supervisor was upset about the allegations.

The girls had already been climbing several times and had very good previous knowledge.

During a free time in Penzberg, he even chose the two of them to secure small children on high rope climbing.

“It is maddening to say the two were not trained.

I'm not someone who does that kind of thing with climbing groups.

I've been doing this for 30 years. "

The defense also vehemently rejects all other allegations: there was a briefing and safety exercises.

First one climbed with "Top Rope", whereby the rope is always hooked at the top.

Only then would some have been allowed to lead.

The woman from Penzberg knew her way around, even had her own climbing equipment with her and showed no signs of exhaustion.

The presiding judge Ute Schmitthenner tried in vain to move the sides to a settlement.

Now witnesses have to be summoned, especially the Penzberger's climbing partner.

"This process will be relatively large," said the judge, "because everything will be disputed with all ends." However, there will be a date for the next hearing in May 2022 at the earliest. Due to the absence of appointments during the corona lockdowns, the files have become pent up in the judiciary.
