The establishment of the development plan "Schleißheimer Straße 45, day care center and social housing" as well as the issue of a change block for the property with the Polz bakery branch is in place.

With 20:17 votes, the majority of the Dachau city council got him on the way in their most recent meeting.

Nevertheless, there was a need for discussion

As a reminder: The property in the best location with an area of almost 2500 square meters was auctioned. The city offered because it was planning to build a mixed use of social housing and day-care facilities here. But she was defeated and the property was bought by a competitor. Thereupon the city administration imposed a so-called change ban on the property "in favor of the common good". She drew up a development plan that stipulates the exclusive use of “day-care centers and social housing” for the area. The new property owner has no interest in this and is planning a purely residential development.

“We should clarify the concept of the common good,” said SPD parliamentary group leader Anke Drexler, opening the discussion in the Dachau city council: “What serves the common good ...” That was the case with a six-group day-care center and social housing project planned here. ÜB / FDP parliamentary group leader Peter Gampenrieder replied. The common good is undisputed. "What bothers us is the timing of issuing a ban on changes after the auction." His CSU colleague Florian Schiller hit the same note: "The approach is a wrong approach."

Lord Mayor Florian Hartmann (SPD) countered this: “There are building laws in force in accordance with Section 34 of the Bavarian Building Act. This results in the value of the property. If we issue a development plan and a ban on changes, the development plan must at least reflect this building law or even more. ”Otherwise there is a risk of compensation. “So there is no monetary loss in value for the buyer.” Sören Schneider added: “As long as the city was planning to buy the property itself, it did not need a change lock. But now it is necessary. ”Wolfgang Moll (WE) wanted to know whether the property purchaser inquired about what was planned here before the commercial property was auctioned.

Building authority manager Moritz Reinhold stated that the buyer had announced his own plans (independent housing construction) to the city, but they had not confirmed them.

The city did not reveal its plans to the potential bidder at the auction.

Incidentally, this is not a commercial area but a general residential area.

"How great are the city's chances in court in this case," said Markus Erhorn (FW / Citizen for Dachau).

"He can't do anything about the change lock," said the building authority manager.
