- Tobias Kalbitzer recently brought up the topic on the sidelines of an event.

Schongau's former vice-mayor wanted to know from the incumbent mayor, Falk Sluyterman, when the popular Schongau bathing raft on the Lido would finally be let into the water.

The reason given by the town hall chief towards Kalbitzer: Because of the corona distance rules that still exist, this is not currently possible.

Sluyterman also regrets the Schongauer Nachrichten that the city is responsible: "The distance concepts are difficult to control on the bathing island."

But this is not the only reason. There is another one that could have consequences for Schongau bathing fans and which is why both the mobile jetty and the popular bathing island will be rebuilt this year, but only for a very short time after the swimming season. As the mayor reports, an expert is to examine the area of ​​the lidos in the fall, taking into account whether the lido with a bathing island and mobile jetty is a simple bathing area or maybe a natural bathing area, which, however, is subject to supervision by the city would pull.

This goes back to a judgment of the Federal Court of Justice (BGH) from November 2017. At that time, after an accident of a child in a natural swimming pool in Rhineland-Palatinate, the BGH had given the parents the right that a supervisor had to keep an eye on the bathing process.

The child got caught in the buoy chain underwater and was without oxygen for a long time, which is why it is severely disabled today.

The 2017 BGH ruling can have dire consequences for Schongau

At the time, this judgment triggered many discussions; jetties, diving platforms, rafts and other bathing platforms were temporarily closed or even dismantled at many bathing areas in 2019.

In Schongau, too, the city initially did not let the bathing raft into the water in 2019 - “out of anticipatory obedience”, as Schongau's manager Bettina Schade justified.

The raft was then allowed back into the Lech from mid-August - only signs indicating a possible danger were put up (we reported).

The external law firm commissioned at the time came to the conclusion that the Schongauer Lido was a simple bathing area, so there was no obligation on the part of the city to supervise.

So why do another investigation when this has already been resolved?

“That was just a kind of interim result,” explains Sluyterman.

In that report there is a recommendation to have the subject of possible liability in the event of accidents examined by a specialist office specializing in pool safety.

“It has to be clarified whether the systems can also be operated from the point of view of the specialist office, whether they may have to be retrofitted or a safety concept drawn up,” said the mayor.

The Administration Academy in Munich is to receive the order for this further examination.

And why didn't this happen in 2020?

This was not possible because of Corona, explains Sluyterman.

And in 2021, the bathing island and jetty have not yet been in the water, but this is absolutely necessary for the report.

Now there should be a separate appointment, after this bathing season, so that nobody can use the jetty and bathing island without authorization.

At the jetty at the Lido, Sluyterman doesn't necessarily see a great risk of injury, "that makes it easier to get into the water more easily".

For the bathing islands, on the other hand, he can imagine a great potential risk.

Ultimately, however, it also depends on how all the facilities on the Lido - island, jetty, showers, toilets - are assessed together.

Who is in charge at the end of the day?

The offer for the final report is probably available, the commissioning should take place these days.

What happens if the Munich appraiser now comes to the conclusion that the Schongau Lido is a natural swimming pool, Sluyterman suggests cautiously: "Then the city council would have to decide whether one wants to afford bathing supervision." Sluyterman: "The case law has worsened, and at the end of the day the question arises who is responsible. "

The citizens are annoyed that the bathing island is missing.
