Ma Jiajian, a 25-year-old young man, was charged with attempted drug trafficking and was sentenced to 23 years in prison. After serving 5 years in prison, the appeal was straightforward.

The judge raised more questions about Paul Chan, a lawyer firm who initially persuaded Ma Jiajian to plead guilty.

On Tuesday (17th), 58-year-old Chen Qiangli, who retired, and 34-year-old Zhang Xiaohui, who dealt with Ma Jiajian’s plea that day, were arrested on suspicion of obstructing justice.

The police today (19) stated that a 58-year-old man surnamed Chen and a 34-year-old woman surnamed Zhang had committed acts that could obstruct justice in a drug trafficking case that occurred in 2016 on August 17 this year. On suspicion of obstructing justice, he was arrested by the police at Cheung Sha Wan Police Station.

The case was handed over to the Regional Crime Squad of West Kowloon. The two arrested men and women have been charged with one count of conspiracy to obstruct justice. The case will appear in the Kowloon City Magistrates' Courts this (19) afternoon.

According to the verdict of the High Court and the Court of Appeal, 20-year-old Ma Jiajian and his friend Hong Zhiqian (transliteration) were charged with attempted drug trafficking at the time of the case. Ma Jiajian signed a confession document on March 7, 2017, and on August 28. In Japan, he pleaded guilty to all charges, but Hong Zhiqian was dropped. In the end, he pleaded guilty and sentenced him to two years in prison only because he was found less than 10 grams of cocaine in his home.

In November 2017, before the sentence of the High Court, Ma Jiajian dismissed the lawyer team and changed his words not to plead guilty. He alleged that the lawyer team was introduced by brother Hong Zhiqian and brother Hong also paid his legal fees. He suspected that there was a conflict of interest.

Looking back at the High Court's hearing verdict on Ma Jiajian’s change of not guilty on December 11, 2018, Judge Zhang Huiling had repeatedly questioned Ma Jiajian’s former lawyer Zhang Xiaohui and "Master" Chen Qiangli (Paul Chan), saying that their statements were hard to make. People are convinced.

When Ma Jiajian contacted his master Paul Chan after his arrest, Ma said that he did not indicate that he wanted to plead guilty. However, during the meeting, Chen pointed out that the case is difficult to win and that the earlier he pleads guilty, the more the sentence will be reduced.

Chen Geng said that there was no evidence against Hong Zhiqian in this case, and Hong had a good chance of getting out.

In the end, the court accepted Ma Jiajian pleaded not guilty.

When Ma Jiajian was tried for drug trafficking in 2019, the trial judge Chen Qingwei had raised many doubts about the prosecution. When the prosecution's external barrister Zhou Jiajun responded to the trial judge whether to continue the case, he said that he decided to obtain the permission of the criminal prosecutor.

The criminal prosecutor at that time was Liang Zhuoran, who has now resigned.

In April 2019, Ma Jiajian was convicted of attempted drug trafficking by a jury and sentenced to 23 years in prison.

July 22 of this year: Ma Jiajian's appeal was straightforward and he was acquitted

In January this year, the Court of Appeal opened. There was a verdict on July 22, and Ma Jiajian was sentenced to appeal and was acquitted. On August 11, the judge issued a sentence.

In addition to his acquittal, which has attracted the attention of the outside world, his master Paul Chan has become the focus of many doubts raised by the Court of Appeal.

The Court of Appeal raised a number of doubts, including why the lawyer's office hired a veteran teacher and why he could visit the defendant and provide legal advice in the detention center.

The Court of Appeal also questioned whether the prosecution agency had investigated the relevant actions of the lawyer team, including the mentor in the case, and questioned whether the prosecution had communicated the trial judge’s question to the senior attorney department.
