The drug commissioner advocates a nationwide uniform limit of six grams for the possession of cannabis.
There should be no prosecution under this.
Berlin - The drug commissioner of the federal government, Daniela Ludwig, spoke out in favor of a nationwide personal consumption limit for cannabis.
It is about the amount of drug that is prosecuted as an administrative offense instead of a criminal offense.
The main difference lies in the severity of the punishment, whereby administrative offenses can only result in fines and crimes in connection with cannabis up to five years imprisonment.
While the current requirements depend on the federal states and vary greatly, Ludwig advocated a uniform limit of six grams throughout Germany.
An overview of the current maximum amounts of cannabis in the federal states that do not lead to criminal prosecution can be found here, although there are not always clear laws on this:
Drug Commissioner: Personal use limit for cannabis as a relief for the police
"A limit above which the possession of cannabis should also be punished as a criminal offense and not as an administrative offense in the future must be set carefully," said the CSU politician on Monday (23.08.2021) in an interview with the editorial network Germany.
The reason for this is, among other things, the “influence on consumer behavior”, with the drug commissioner also citing lower risk compared to cocaine or heroin and the relief of the police and judiciary.

According to Ludwig, people who are caught with cannabis quantities below the limit of six grams should be able to choose whether to pay a fine or undergo addiction counseling.
In addition, the drug commissioner called for so-called drug checking to be permitted in Germany in the future.
The point is that consumers can have drugs analyzed by the state for harmfulness to health: “Drug checking means minimizing damage and can save lives,” said the drug politician and complained about the misconceptions that prevailed in many places about the concept.
Only recently, the FDP * party congress voted for the decriminalization of all drugs * - and quickly corrected itself.
