20-year-old embezzles money from a disabled colleague

- Judge Dieter Kaltbeitzer described the actions of the defendants as "morally very reprehensible" on Wednesday.

The 20-year-old Forstinningerin had to answer for assault and theft before the Ebersberg district court.

The woman admitted both.

Between 2018 and 2020, she hit her grandmother twice in an argument that caused her pain.

In court, she told of one of the two incidents: Her grandma should have driven her to the train station.

The 20-year-old's brother intervened in the dispute, "and I was violent," she said in court.

She is now trying to behave differently at home.

The climate has "already improved a lot".

Defendant in court: "My grandma is the only thing I have."

"My grandma is actually the only thing I have," she said in court.

Her parents separated when the defendant was in first grade.

At first she lived with her mother, then with her father for six years with her grandmother.

Her father died four years ago.

There is no contact with the mother.

Judge Kaltbeitzer refrained from interrogating grandma and brother after the accused's confession.

The improving relationship should not be strained any further.

The 20-year-old also immediately admitted the theft, which she was accused of.

She persuaded a work colleague with Down syndrome to give her 300 euros, which she wanted to use to buy shoes.

In the end, 1000 euros ended up in the money slot that she had put in her pocket.

The public prosecutor accused her of entering the wrong amount herself.

The defendant said she no longer knew exactly how it went.

But she thinks that her colleague has given her too much money and that she just failed to point it out to him.

Three different video recordings were viewed in court.

Judge Kaltbeitzer: embezzlement instead of theft

Judge Kaltbeitzer then came to the conclusion that the defendant's colleague had probably also wanted to withdraw money for himself and therefore actually entered the higher amount.

The 20-year-old immediately took everything while her work colleague put his money card back in.

The question that asked himself: Was it really theft?

Because the colleague first had to remove the card to get the money, it was not in his custody at the time of the crime.

The defendant was therefore not guilty of theft, but of embezzlement.

"In retrospect, I'm ashamed of myself that I did that," she said.

Judge Kaltbeitzer finally sentenced the 20-year-old to leisure arrest, i.e. a weekend in prison.
