The daughter with four shortcomings is not admitted to the eighth grade exam, the family appeals to the TAR of Genoa which, however, agrees to the teachers and rejects it. It happened in the province of Imperia. When, last June, the teaching staff of a school in the Imperia area decided not to admit the girl to the state exam, the family, through their lawyers, filed an appeal claiming that - according to the TAR sentence - the non-admission to the eighth grade exam "would have been traced exclusively to the reported insufficiencies, without a specific reason" and that there had been a "difference in treatment compared to other pupils who had achieved insufficiencies in some subjects", but despite this they had been admitted to the tests. L'Pupil had insufficiencies in English, mathematics, science and history and, in the opinion of her teachers, had a "very poor preparation and maturity not yet adequate to face secondary school.

The TAR rejected the appeal claiming that "the assessments of the class council in the final ballot regarding the promotion of a pupil, and the assessments on the degree of insufficiency of the preparation achieved in the various subjects, as well as the compatibility of this with the possibilities of recovery of the pupil, are the expression of a judgment of technical discretion that belongs only to the class council "which must give a reason for the decision taken. Furthermore, no unequal treatment was found as "only one pupil was admitted to the state exam with only one insufficient evaluation, compared to the four shortcomings of the applicants' daughter".
