The Polish constitutional court does not want to deal with the question of whether the Polish constitution is above EU law until September 22nd.
The meeting scheduled for Tuesday had been postponed so that the court could deal with the request of the human rights commissioner Marcin Wiacek for the expulsion of a judge, said the court president Julia Przelebska in Warsaw.
A decision in the case has already been postponed several times.
Prime Minister Mateusz Morawiecki had asked the constitutional judges to review a ruling by the European Court of Justice (ECJ) from March.
In it, the top EU judges had ruled that EU law can force member states to disregard individual provisions in national law.
This applies even if it is constitutional law.
Due to the reforms of the Polish judicial system, the EU Commission has already opened several infringement proceedings against the government in Warsaw and has filed lawsuits with the European Court of Justice.
Among other things, the Brussels authority has doubts about the independence of the Polish constitutional court.
The chairwoman Julia Przylebska is a close confidante of PiS boss Jaroslaw Kaczynski.
