This is what it says in three languages ​​on the now tattered banner that entrepreneur and builder Klaus Dieter Burkhart has posted on Schwaighofstrasse. Burkhart is head of the German Center for Fresh Cell Therapy based in Bad Tölz.

As such and for his project in Tegernsee, he founded Burkhart Immobilien Bau- und Verwaltungs GmbH.

He was welcomed in the city with open arms when he presented his plans to the public for the first time in August 2016.

After violent protests had brought down the previously planned 300-bed bunker of the A-ja hotel chain, the Burkhart project appeared to be a welcome solution.

The sanatorium and two clinic buildings are part of the approved planning

On the 12,900 square meter area that Burkhart acquired from Unicredit - at extremely favorable terms, as it is called - three buildings are now to be placed in a rather untypical location.

In the rear area a sanatorium with 19 rooms and 35 beds is being built, to the south and west of it two clinic buildings with 99 rooms and 109 beds as well as seven apartments.

An underground car park with 89 parking spaces, 26 above-ground parking spaces and a pavilion are also part of the approved construction project.

The project continues to be accompanied by headwinds

The project continues to receive criticism. The Schutzgemeinschaft Tegernseer Tal (SGT) issued several statements and found that with the three curved structures, which have no tradition in the valley, only an attempt is being made to make the building dimensions look smaller. “It's unbelievable what nature is destroyed and then nothing happens,” she comments on the current situation.

Neighbors don't give up on their protest either.

Two proceedings against the building permit have been pending before the Munich Administrative Court since January, as confirmed by Susanne Beer, judge and spokeswoman at the administrative court.

“In the lawsuits, violations of the immission control law as part of the structural requirement of consideration, a landslide risk and a violation of the spacing areas are asserted,” said Beer.

The plaintiffs speak of "ruthless development" by the four and five-story houses.

Why is the project not progressing faster?

All of this feeds speculation about Burkhart's concept.

So far it has been based on fresh cells and the "continuous expansion of our therapy offers", as can be read on the homepage.

In May, the federal government issued a ban on the use of fresh cells of animal origin in the manufacture of pharmaceuticals ("Fresh Cell Ordinance").

Burkhart's therapeutic approach, for which he last advertised at a beauty fair in China in September 2019, should therefore be obsolete.

Mayor Hagn: "There is a building obligation"

What if the project fails? “There is a construction obligation,” says Mayor Johannes Hagn and reminds us that the city has installed all the fuses. "There is a project-related development plan and an implementation contract, but no agreement that it has to be operated as a fresh cell clinic." In addition to the construction obligation, there is also a time frame that is currently still unproblematic and that can be extended due to Corona, according to Hagn. “Should Mr. Burkhart not be able to realize the plans, he would have to withdraw from the contract, for an alternative development the city council would have to deal with a new development plan procedure. But that's all speculative. ”However, Hagn rules out the possibility of residential development.
