The Erding District Court has imposed preventive detention against nine climate protection activists.

The five women and four men took part in the actions on Tuesday that paralyzed traffic around Munich.

They abseiled down from motorway bridges to protest against the IAA Mobility auto show.

"It is about preventing further criminal offenses," explains court spokesman Thomas Lindinger.

Detention is a measure under the Police Tasks Act (PAG).

"The last amendment to the Police Tasks Act changed Article 17 PAG so that longer preventive measures are permitted," explains the lawyer from the Erding District Court.

A total of eleven activists were taken into custody on Tuesday and questioned by the criminal police in Erding.

According to Lindinger, they come from all over Germany and are of mixed ages.

They are accused of dangerous interference in road traffic, coercion and damage to property.

"You have basically not said anything about the matter," said the court spokesman.

Three investigating judges of the district court decided on Tuesday evening on the continuation of the deprivation of liberty.

One woman has been released.

Four male activists were then to be brought to the Landshut prison and five women to Stadelheim.

Another activist has to make this decision on Wednesday.

She even refused to give any information about her identity.

There is preventive detention in every German federal state.

Normally, the imposition of the person concerned is intended to prevent them from committing or continuing a serious administrative offense or criminal offense.

Only in Bavaria, however, is detention permitted even to avert danger to an important legal asset.

Above all, this point in the Police Tasks Act, which has been in force since August 2017, had led to considerable protests and lawsuits against the same.

Bavaria is also the only federal state that can impose preventive detention for up to two months, while the period in the other federal states varies between one and 14 days.

Activists painted the sentence “Climate protection is not a crime” on a large cardboard cover and unpacked a megaphone so that the law enforcement officers could hear the climate protection slogans behind the closed windows.

The purpose of the rally was to show solidarity with fellow campaigners, explained the activists with the banner when asked by the local newspaper.
