Drivers who drove on Putzbrunner Straße at the end of August despite the closure and were therefore warned by the police may not have to pay a warning fee.

Because, as Friedrich Rutz, one of the drivers concerned, rightly complains, the signs for the closure were not correctly set up for several days.

Ottobrunn

- The Ottobrunner has successfully raised an objection to the warning and wants to draw the attention of those affected to it. On Friday, August 27th, around 3 p.m., Rutz wants to go home after something has been done. From the Hypovereinsbank parking lot, he drives his car onto Putzbrunner Strasse, and then immediately turns left into Gartenstrasse. But the 55-year-old doesn't get much further. Because he is stopped by two police officers at about the level of the kindergarten. "The police had just finished warning another driver and told me straight away that I had driven here illegally," he says. But Rutz does not believe that he has behaved wrongly, refers to the traffic sign "Prohibition of entry", which was placed on the left in his direction of travel. He therefore assumed that he could use his lane. “At my urging, the police took me to the traffic sign to look at the signs. Both were of the opinion, however, that everything was set up correctly. ”So the Ottobrunner is warned and is supposed to pay 25 euros for the offense.

But the 55-year-old does not want to accept that.

He documents the signage with a photo and researches - with success: "The explanations for traffic sign 267 state that the sign must be on the right-hand side of the lane for which it applies, or on both sides of the lane," he explains Ottobrunner.

With this knowledge he drove to the police station and confronted one of the police officers again.

"He still claimed that the signs were correct," says Rutz.

Only when Rutz objects in writing to the warning does the matter move.

Police stop warning

The police officers, who have meanwhile done their own research, inform the Ottobrunner on the following weekend that the warning against him will be discontinued.

As one of the officials announced, "the signs were placed incorrectly shortly before Gartenstrasse".

Rutz could have left it with that.

But he annoys that the officials did not apologize for the faux pas.

He also suspects that numerous other road users have been wrongly warned.

“At least four drivers that I personally saw were warned.

I guess there were more. "

The head of the local police station, Armin Ganserer, cannot say how many people are actually affected.

For reasons of data protection law, it is not possible in retrospect to find out who received a warning for which administrative offense and when.

Also, one does not know since when the signs were wrongly placed.

“What is certain is that there was no traffic sign on the right at this point on the day in question.” On Monday, the signs were corrected immediately, so that there was a period from August 27th to August 30th during which motorists could have been warned at this point .

Those affected should raise an objection

Ganserer also points out, however, that the construction site on Putzbrunner Strasse - a new water pipe is being laid on Kreisstrasse - has been in existence since the beginning of June. “Actually every Ottobrunner should know by now that he is not allowed to drive there.” In addition, a little further ahead, at the intersection with Rosenheimer Landstrasse, a corresponding traffic sign had been put up on the right-hand side with the addition that an access only to Hypovereinsbank -Parking is allowed. Ganserer advises those potentially affected to object to the warning in order to be able to clarify the matter. Citizens are also welcome to turn to the “Traffic” department of their inspection.

It is unclear who is responsible for the incorrect signage. The construction company may not have set the lock down properly. But Ganserer does not want to rule out the possibility that a "joker" or angry road user has laid hands on it.
