In the Shichang mini-warehouse where a level four fire occurred, its branches in Yau Tong, Kowloon Bay and San Po Kong were charged with 11 crimes by the Fire Services Department, alleging that the three branches did not provide sufficient windows, signs and modified compartments.
The case was presented to the Kowloon City Magistrates' Courts today (8th). The company representative said that because a similar case is undergoing judicial review, the case was requested to be postponed until December 8 this year in order to wait for the outcome of the case.
The prosecution did not object to the application, so the magistrate approved the adjournment.
The defendant was Shichang Logistics Co., Ltd., a company operating Shichang mini-warehouses, and the locations involved in the case were branches in Yau Tong Industrial City, San Po Kong Leeson Factory Building and Hong Leong Industrial Centre in Kowloon Bay.
Some mini-storage operators have filed a judicial review earlier, stating that the Fire Services Department has only the authority to regulate the fire protection facilities of buildings, but it also restricts the fire hazard notice issued by the industry, including the layout of buildings and windows. Ultra vires, but the High Court ruled earlier that the case was lost.
It is understood that the relevant operators have appealed the case.
