In April, May and July this year, the DAB commissioned the "Hong Kong Public Opinion Survey Center" to conduct a poll, stating that more than half of the respondents supported legislation to deal with "distributing fake news" and "spreading hatred."

The party’s Legislative Council members Ge Peifan and Chen Hengpin suggested that the government enact the “Online False Information Act” and at the same time amend Article 9 of the “Criminal Offences Ordinance” to clearly include acts of inciting hatred, hostility or contempt against public officials and their families as Illegal behavior.

Ge Peifan emphasized that the "Online False Information Law" only targets individuals and remarks that violate national security, not the news media, and emphasizes the belief in the professionalism of news media.

When asked whether the professional media included the "Apple Daily", Chen Hengbin said that Apple violated the "National Security Law", and pointed out that professional media should not be used together with the "Apple Daily".

The "Information Law" meets the three standards, and the regulation must be related to national security

The "Hong Kong Public Opinion Survey Center" randomly sampled more than 1,000 people by telephone from April 12 to 18, May 18 to 26, and July 15 to 21.

In the three surveys, 57.6% to 63.5% of the respondents said they agreed with legislation to deal with "distribution of false information"; 30.6% to 33.8% disagreed.

In addition, 52.8% to 55% of the respondents agreed with legislation to deal with "spreading hatred," while 35.1% to 37.3% disagreed.

The DAB proposes to enact the "Online False Information Act", emphasizing that the law must comply with three major criteria, including compliance with the Hong Kong Human Rights Law and the International Covenant on Civil and Political Rights, that is, the restriction of rights by the law must be based on protection National security or public order, public health or ethics must be restricted to the regulation of false fact statements that affect national security or the public interest, and an appeal mechanism must be established to provide protection.

The party also proposed to amend Article 9 of the Criminal Offences Ordinance to explicitly classify incitement to hatred, hostility or contempt against public officials and their families as illegal acts.

It is also recommended to further promote information literacy education and publicity, subsidize research teams to develop and launch applications that identify false information, and refer to the EU’s "Code of Practice on False Information" to formulate specific codes of practice for social media in Hong Kong.

After the implementation of the National Security Law, "radical thinking has not converged"

Ge Peifan said that fake information is not available every day. Many young people are influenced and instigated by information such as "Blow Eyes", "Xinwuling Sexual Assault", "Prince Edward Station Killing People" and other information. "Although it has been implemented, "radical thinking is not converging." Fake information that incites violence and hatred is still flooding online platforms. For example, some people claim that universal testing will "send DNA" and affect the government's anti-epidemic work.

Ge Peifan said that the party will hold a round table meeting to invite scholars and experts to express their opinions, so as to formulate more detailed plans to promote government legislation and regulation.

She emphasized that the "Online False Information Law" only targets individuals and remarks that violate national security, not the news media, and emphasizes the belief in the professionalism of news media.

When asked whether the anti-gay remarks made by Member of the Legislative Council, He Junyao, were inciting hatred, Ge said he did not comment on the remarks of other legislators.
