A year

ago

,

Tahiel

, who was 6 years old, was hit by a car because two drivers who

were running into a dive on Route 21

, in Laferrere, lost control of their cars.

And although those responsible for the tragedy continue to be

detained

, the victim's family fears that they may obtain the benefit of

house arrest, something that they have requested without success until now.

Tahiel's parents want those responsible to arrive in prison for the

oral trial

, which still has no date.

This

Friday at 10

o'clock they

will demonstrate on

Route 21 and Soldado Sosa

, where Tahiel lost his life on September 13 of last year, when he was going to have an ice cream with his father, Luciano Contreras, and his mother Noelia Díaz.

At that time, a Chevrolet Corsa and a Volkswagen Vento, driven by

Nahuel Agustín Olivera, a 22-year-old radiologist, and Alexis Escribanti

, a 24-year-old baker, were speeding from several blocks earlier.

The Corsa de Olivera got lost and hit a VW Fox that was stopped at the traffic light, which was the car that hit the family.

Tahiel died in that instant

.

Olivera was detained at the time, as was the Fox host, who was later released.

Escribanti escaped and fell a few days later, when he was found by the police in a house in Laferrere.

Tahiel's family will demonstrate on Route 21, in Laferrere, where the 6-year-old boy died last year from a bite.

Both drivers are accused of

simple homicide with eventual intent

, a crime with stipulated penalties of between

8 and 25 years in prison

.

But as the elevation to trial is delayed, Tahiel's relatives fear that Olivera and Escribanti will ask for

house arrest

.

Since the tragedy occurred, both defendants requested

house arrest

three times

.

The case is in charge of the court of guarantees No. 5, which denied them.

"We hope the oral trial as soon as possible, that the Justice advances. A year has passed and everything is still the same. We want the trial to advance so that they are not released and have their sentence.

We want them to pay.

No one is going to give us back our only son and it is very difficult to live like that, to have this life that we lead, "

Tahiel's mother

tells

Clarín

Noelia.

This is how one of the cars was left that after the bite in Laferrere caused the death of 6-year-old Tahiel.

During this year that passed since the tragedy, Noelia had psychological assistance.

And in June,

Diego Dieguez Ontiveros

, the lawyer who represented them, died, so they had to get a new one.

Noelia says that

"there is a lack of expertise

, which will be done on September 14, one day after the date Tahiel died."

And he insists: "We want the trial to begin as soon as possible. These kids

cannot be released again

. They have to pay for what they did."

Last year, a few weeks after the tragedy, the residents of Laferrere joined the Tahiel family's claim and added their complaint about the

bites that are frequent in the area.

In October 2020, the so-called "Tahiel law" entered Congress.

The initiative of the deputy of the Frente de Todos Ramiro Gutiérrez was promoted by the Ministry of Transport, through the National Road Safety Agency (ANSV).

And he seeks that killing running a dive is

a crime equal to simple homicide.

The objective is to create the figure of

"road homicide"

, with a penalty of 8 to 25 years in prison.

Almost at the same time, María Luján Rey, from Together for Change, presented another, known as

"Kevin Law

, promoted by Viviam Perrone, the founder of Mothers of Pain, and named in memory of her son, who died at 14 years after being run over and abandoned by Eduardo Sukiassian in 2002.

It also seeks to

increase sentences for participating in illegal racing

and for reckless driving. And it proposes that the

escape of the driver or that he is under the influence of alcohol or drugs

be considered as aggravating

.

In the same vein, this year another project that proposes

zero alcohol

for drivers

entered

. And from Mothers of Pain they seek to collect signatures through the change.org platform.

None of the projects show significant progress.

Although in the case of Tahiel the accusation is

"simple homicide with eventual intent"

, in many cases of road accidents that end in deaths, the accusations end up being for

manslaughter

, a criminal figure that considerably reduces the sentences.

Running bites is a crime that is provided for in article 193 bis of the Penal Code.

The

 stipulated penalty is ex-jail

: from 6 months to 3 years in prison and special disqualification from driving for twice the time of the sentence.

The same penalty applies to the driver, the organizer, those who promote the activity and the owner of the car, even if it is not who was driving it.
