Discontinued procedure Horse ranch: Free voters demand legal review

Füssen - After the building committee rejected the subsequent legalization of illegal buildings on a pony and horse ranch at the request of "Füssen-Land", the Free Voters parliamentary group now applies for a legal review of this step. 

Christian Schneider's application included the immediate suspension of the development plan procedure and the repeal of the previous resolutions as well as the recommendation to the Ostallgäu district office to demolish the illegal buildings.

Because, in their opinion, a procedural error has occurred here.

The Bavarian municipal code regulates exactly which content is permissible for a procedural proposal.

“These are exclusively procedural regulations on the course of the meeting and the agenda.

The 'procedural motion' submitted by Mr Schneider does not fall under this list, but is a substantive motion with substantive legal content, ”Derday and Doser agree.

Therefore, Schneider should have submitted his application as a substantive application in the correct form and in due time.

It should not have been dealt with immediately as a point of order.
