Compulsory vaccination: D-day for nursing staff

From this Wednesday, September 15, healthcare professionals must have received at least one dose of anti-Covid vaccine to continue to exercise.


"

No question of tolerance or accommodation

", questioned Thursday, September 9, the director of the regional health agency (ARS) of Île-de-France, Amélie Verdier, recalled the determination of the political and health authorities to make respect the vaccination obligation for health professionals.

As of Wednesday, September 15, liberal caregivers, home helpers, firefighters, paramedics, hospital and retirement home employees ... All must have received at least one dose of vaccine against the coronavirus.

They will then have one month, until October 15, to complete their vaccination schedule.

About 2.7 million people are affected by this measure.

In case of refusal it will be possible to suspend the employment contract of the refractory employee. A provision made possible in the law as explained by the Minister of Labor, Élisabeth Borne, at the time of the announcement of the measure on July 12: "

we will provide in the law [...] a special provision for the suspension of employment contract, since the person is not in a position to exercise their profession if they have not been vaccinated

”. This suspension will go hand in hand with the non-payment of wages, as long as the employee is not in good standing. For its part, the establishment may receive a fine of up to 9,000 euros and one year of imprisonment in the event of repeated violations of the vaccination obligation.

Same situation for private health professionals.

Failure to comply with the vaccination obligation will be punished with a fine ranging from 90 to 375 euros.

Beyond the third verbalization within 30 days, the facts will be punished by six months of imprisonment and a fine of € 3,750.

Convince the recalcitrant

The goal is clearly to convince the individuals concerned to be vaccinated, as Amélie Verdier explains:

"we hope that those who still hesitate will be convinced by the firmness displayed"

. A threat that seems to be paying off. According to Public Health France, 89.3% of people working in nursing homes and long-term care units (USLD) had received at least one dose on September 12. This figure rises to 94.6% for private nursing staff.

With such a figure, there is little risk that hospitals and other health establishments will be forced to close services for lack of staff.

On the other hand, the situation could be more tense in certain nursing homes or small structures.

Indeed, it will not always be possible to compensate for staff laid off by liberal health professionals:

"it is illusory to think that all suspended employees can be replaced by temporary workers,

" warns Pascal Champvert, president. of the Association of Directors in the Service of the Elderly (AD-PA).

For their part, the unions say they are worried. Thus Fo-Santé is asking for “

additional time

” in order to defuse “

unmanageable situations

” in certain hospitals, where “

closures of services and beds are being considered

” due to the insufficient number of vaccinated agents. The CGT, which had even called for demonstrations on Tuesday, September 14 against the vaccination obligation, warned of a "

health disaster

" if the refractory staff can no longer exercise. The number one of the reformist union CFDT, Laurent Berger, had called Thursday to "

avoid as much as possible that people are sanctioned

".

France is not the first country to force part of its population to be vaccinated. Greece, Italy, Hungary, Australia, Canada, Gambia, Zimbabwe ... a growing number requires certain professional categories in health, tourism or administration.
