A 22-year-old young man was detained for 18 days, accused of sexual abuse committed by a 24-year-old homonymous and nicknamed “Chuvi”.
The delay in releasing him made even the victim's mother take the lead in the protests made by her relatives, first in front of a police station and this Thursday before the Oberá Investigative Court, in Misiones.
Almost two years after the complaint was filed, the Police arrested Neris Gabriel Ferreyra when he was working as a bricklayer in the home of an officer from the Women's Police Station.
The young man had no prior record and
told the police that they had the wrong person
.
Nothing reached and from August 30 and until this Thursday he was housed in a cell of the 5th section.
of Oberá.
Even the mother of the victim warned the investigators that the "Gabriel Ferreyra" they were looking for was another and that he responded to the nickname "Chuvi".
After several days, the police officers admitted that they had arrested the wrong person, but said that everything had already been prosecuted and that
the eventual release depended on Judge Horacio Alarcón
.
The investigation was triggered at the end of November 2019 when a woman appeared at the Oberá Women's Police Station and denounced that her brother-in-law “Chuvi” had sexually abused a three-year-old girl, her minor sister-in-law, and had threatened everyone so they wouldn't tell what happened.
The mother of the young man wrongly detained for a case of sexual abuse in Oberá.
The parents of the erroneously detained young man managed to contact the complainant this Monday and there they finished confirming that Gabriel was unjustly housed in a small dungeon.
The mother of the abused girl said that, despite what happened, her 17-year-old daughter was still in a relationship with “Chuvi”, who is 24 years old.
He even provided the place where they lived, although the Police still cannot find it.
Nélida, Gabriel's mother, said that on Tuesday the complainant went to the police station to clarify the situation, but there they told her that it was the judge who had to respond to the request for release.
From the Justice they only asked "patience"
.
Desperate for the passage of time, this Wednesday afternoon they held a demonstration in front of the 5th section, where the young man had been staying since August 30.
And on the morning of this Thursday they transferred the claim to the judicial headquarters.
The complainant said that the Court never summoned her to testify and was not notified of the arrest of the alleged abuser.
"We found out from the parents of the boy who is in prison," he said.
The detainee's partner said that they not only differ in age from the alleged abuser, but also in the jobs they perform and the tattoos they have.
After noon on Thursday, Judge Alarcón sent an official letter to the Police notifying the release of the young man, although he will continue to be linked to the investigation at least until "Chuvi" is arrested and it is proven that he was indeed the author of the abuse.
