About the speed limit of 20 in the Lochhauser Straße - and about a parking ticket that he received in May.

To date, he has not paid the fine for a number of reasons.

Shortly before the 84-year-old was flashed on May 12, he drove out of the S-Bahn parking lot onto Lochhauser Straße. "Coming from the parking lot on the right into Lochhauser Straße there was no sign," remembers Schmidt. There is only a Zone 20 sign on the left side of the exit. As a result, he was not aware of the 20 km / h speed limit, which also applies when turning right, when he drove on towards AEZ. The radar device then flashed at number 28.

But even a sign that is attached to the left can be used to drive to the right, says the Puchheim city administration when asked by the daily newspaper. In a special case, traffic signs can only be placed on the left, explains Andre Ameri, Head of the Public Safety and Order Division in Puchheim. This special case is on Lochhauser Strasse, as it is not possible to attach it there on the right-hand side. In this case, the city of Puchheim even consulted the responsible police station in Germering.

At the beginning of September there is still no double signage at the parking lot exit, says the 84-year-old Schmidt. In the meantime, tempo 20 markings have been drawn on the road. "That was done shortly after my complaint in May," says Schmidt. Because he did not pay the fine of 35 euros, but complained in return about the lack of signage. “The painting was probably only put on because of my first objection,” says the retired engineer.

According to the head of department Ameri, the floor markings were actually applied at the end of May, “as an additional clarification”.

But: "It is basically not legally mandatory to mark the current speed control of a road on the ground," explains Ameri.

This was done as a supplement to the signage.

In response to Schmidt's further statement that ten or 20 kilometers per hour are only allowed on private property and are therefore invalid in Lochhauser Straße, the head of the department replies: “According to the road traffic regulations, a speed limit of 20 can be set up in central urban areas with a correspondingly high number of pedestrians will."

The speed limit on Lochhauser Straße was set at the end of October 2020.

After that, according to Ameri, the citizens were allowed to acclimatise to about three months without flashing.

At the same time, digital speed indicators were attached.

Hans-Joachim Schmidt has not yet paid the fine.

He also appealed against the second fine in June in the amount of 63 euros.

To this day he has received nothing.

He sees the current Tempo 20 rule as a danger to all road users.

Pedestrians and cyclists are particularly at risk from motorists who now constantly keep an eye on their speed on the speedometer.

“And I'm already being overtaken by cyclists,” says the Puchheim resident.

The only thing missing is that they ring.
